The applicant seeks the following development standards variance approval:
Docket No. 07030004 V Section 25.1.1.B.3.a.iLa garage setback on corner lot
The site is located at 1201 E 106th St. and is zoned R-3/Residence within the Home Place Overlay.

The petitioner
seeks variance
approval for a
garage addition,
specifically its
setback.
Analysis:

-' w comer lot, which
means it has two front yards and two front yard setbacks. A garage on a comer lot is supposed to be
located behind the front line of the primary structure/home, and not within the required front yard. In the
R-3 district, the front yard setback is 30 feet from the proposed road right of way, which is about 30 feet
wide. Since this is a building addition to an existing legal non-conforming or 'grandfathered' garage, a
variance approval is needed.
Findings of Fact:
1.) The approval of this variance will not be injurious to the public health, safety, morals, and
general welfare of the community because: the garage addition will be added to an existing
grand fathered garage. It will complement the existing architecture and color.
2.) The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because: the garage addition will be added to an
existing grandfathered garage. It will complement the existing architecture and color.
3.) The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because: a separate, additional garage will have
to be built on the lot, in addition to the existing garage, which may not be the best layout option
for this comer lot that has a historic home located upon it.
Recommendation:
The Dept. of Community Services recommends positive consideration of Docket No. 07030004 V after
all questions/concerns are addressed.
