This is a variance request of 2.5 feet. Analysis: The homes within the Village of West Clay are placed on smaller lots. Opportunities for private outdoor areas are limited. The outdoor patio of one home is on a different grade level that the screened porch of the adjacent neighbor. The need for privacy arises when a 6-ft fence does not provide the necessary screening so that one neighbor cannot look into the patio of another neighbor. The homeowners' association has reviewed the fence proposal. Findings of Fact: 1.) The approval of this variance will not be injurious to the public health, safety, morals, and general welfare of the community because: the variance request is for 2.5 feet of fence height. This will help create privacy between neighbors on these properties that abut each other, that have homes that are fairly close to each other. o 0:: w Z S o I- ST 2.) The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the variance request is for 2.5 feet of fence height. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: The fence will have to be reduced to 6- ft in height, which may not adequately provide the necessary privacy/screening, and possibly negati vely affect the quality of life for the two homeowners. - Recommendation: The Dept. of Community Services recommends positive consideration of Docket No. 07020024 V and after all questions/concerns are addressed.
