'....,. - April 23, 2007 Docket No. 07030028 V Dear Council Members: The Review Board for the Village of WestClay maintains that side yard fences be limited to six feet. Sundown Gardens first proposed this 8' fence in September 2006, in conjunction with a fencing submittal for Lot 443. The review Board stated flatly that only a 6' fence would be allowed. In October, Sundown Gardens resubmitted this 8' tall fence as part of a trellis for Lot 444. Again, the Board stated that only a 6' fence would be allowed, but this could be incorporated into the 8' trellis. An on-site meeting was held in February 2007 to discuss this fence that had been built greater than 6' tall (-7' -3") and the possibility of raising the trellis to -10'. The Board's response was that only a 6' tall fence is allowed, but if a variance was received from the City, we would not force the owners to bring this fence into compliance. Again, the Review Board is adamant about not allowing fences greater than six feet tall. It is our recommendation that this variance for an 8' -6" fence be denied. If your clients wish to maintain their existing, non-compliant fence at its current level, they must request and receive a variance from the City of Carmel. Please contact Angie Conn at 571-2417 or email her at aconn@carmel.in.gov to request a Development Standards variance. They determined that a 48" high fence on the south of the house would be acceptable. This is in conjunction with the previously approved 6' high section. However, the Board is adamant about not allowing an 8' tall fence on any property line. That being said, we looked very closely at the proposed trellis for Lot 444. The Board had approved a trellis whose beam is placed at 8' to the bottom. If this trellis were to continue in some fashion for two more bays to the east, that may be acceptable. I have attached a conceptual sketch of something the Board would allow. It shows solid fencing to 6', which is within the guidelines for fences located along property lines, and trellis above. The ARB would consider this to be one trellis and not a fence that is greater than 8 feet tall. We realize that you are working with both clients and perhaps you should be the one to discuss this with them. It seems there will have to be a lot of coordination between both parties. If you can come up with another solution, we'd be happy to entertain other possibilities. Please contact me if you have any questions.
