Cherry Creek Estates, Sec lA, lots 1-3 The applicant seeks the following development standards variance approvals: Docket No. 07040001 V Chapter 25.16.12 time limit for model home (lot 1) Docket No. 07040002 V Chapter 25.16.12 time limit for model home (lot2) Docket No. 07030030 V Chapter 25.16.12 time limit for model home/sales office (lot3) The sites are located at 5840-5868 Cherry Creek Blvd. and are zoned S-l/Residence-ROSO. Filed by Ann Walker Kloc ofPulte Homes ofIndiana, LLC. General Info: The petitioner seeks approval to extend the time limit (by 2 years) for 3 model homes and a sales office within one of the model homes at Cherry Creek Estates subdivision. Analysis: Model homes are often necessary to showcase the house products offered for sale within a subdivision. The model homes are currently in existence. The sales office that was in the sales trailer last year has been moved into one of the model homes, since it is more attractive from the exterior. r o o :> -l o ;;0 Findings of Fact: 1.) The approval of this variance will not be injurious to the public health, safety, morals, and general welfare of the community because: the model homes and temporary sales office are currently in existence; only an extension of the time limit is being requested. 2.) The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the model homes and temporary sales office are currently in existence; only an extension of the time limit is being requested. 3.) The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: The model home will have to be sold to homeowners and the sales office will have to cease existence within this subdivision, possibly causing a hardship on the company trying to sell homes. It may also hurt potential homeowners by taking away a convenient on-site sales office. Recommendation: The Dept. of Community Services recommends positive consideration of Docket Nos. 07040001-3 V.
