This evaluation is intended to assess the level of compliance with 327 lAC 15-5 (Rule 5). It is also intended to identify areas where
additional measures may be required to control erosion and sedimentation. All practices recommended in this report should be
evaluated as to their feasibility by a qualified individual with structural practices designed by a qualified engineer.
All erosion and sediment control measures shall meet the design criteria, standards, and specifications outlined in the "Indiana
Handbookfor Erosion Control in Developing Areas" or similar guidance documents.
Current Site Information: Land development is completed. Home construction continues. Perimeter protection is
being used on some homes. The fabric socks have been destroyed on some sites without being replaced. The sites
look better than in November. Better compliance is still needed.
The Following Items Have Been Evaluated and Assigned a Designation of:

v. Mal}'\tenance ()f'L$)t$ and Impr()vements. The Owner of ~y lot in the Development shall at
all times maintain the Lot and any improvements situated thereon in such a manner as to prevent the Lot
or improvements from becoming unsightly and. specifically, such Owner shall:
(i) Mow the lot at such times as may be reasonably required in order to prevent the
unsightly growth of vegetation and noxious weeds.
(ii) Remove all debris or rubbish.
(iii) Prevent the existence of any other condition that reasonably tends to detract from or
. diminish the aesthetic appearance of the Development.
(iv) Cut down and remove dead trees.
(v) Within sixty (60) days following completion of a house on a Lot. the Owner shall
landscape the Lot, weather pennitting.
W. A$sociation's Right to Perfnnn Certa;n Maintena.nce. In the event that the Owner of any Lot
in the Development shall fail to maintain his Lot and any improvements situated thereon in accordance
with the provisions of these Restrictions, the Association shall have the right, but not the obligation, by
and through its agents or employees or contractors, to enter upon said Lot and repair, mow, clean or
perform such other acts as may be reasonably necessary to make such Lot and improvements situated
thereon, if any, conform to the requirements of these restrictions. The cost therefore to the Association
shall be added to and become a part of the annual assessment to which said lot is subject and may be
collected' or a lien placed upon the Lot. Neither the Association nor any of its agents, employees, or
contractors shall be liable for any damage which may result from any maintenance work performed
hereunder.

a) Yards. Following the Construction of a dwelling unit on a Lot, the front yard of each such
Lot shall be smoothly graded and properly seeded or sodded with a clay based Kentucky bluegrass and
Ryegrass mixture.
b ) Yard Trees. The front yard of each Lot within the Development shall continually contain a
minimum of two (2) trees, with a minimum height of eight (8) feet with a 2.5 inch caliper. These trees v"

c) Lm Tree Preservation. In areas of the Development where trees are existing on a Lot, every

to preserve and maintain the trees located in those Common Areas or generally maintaining those
Common Areas in a healthy and safe condition; including) but not limited to, the removal of dead,
decayed or dangerous trees or vegetation to prevent imminent hazard or prevent the threat of fire. The
following actions and activities shall be specifically prohibited in the Common Areas:
(a)
the constrUction or maintenance of any buildings) structures or other
improvements, other than entty walls, fencing or as otherwise expressly permitted
herein;
(b). the dumping or other disposal of traSh, garbage or other refuse of any nature
whatsoever in or on the Common Areas;
(c) earth moving or grading or filling,

the cutting or clearing of timber or trees, or intentional buming, except as
detennined to be necessary by the Association to control or prevent imminent
hazarci. disease or flte; and .
(e) the construction, maintenance or erection of any sign Or billboard on or in the
Common Areas other than subdivision identification signs approved during initial
subdivision construction..
Notwithstanding the above provisions, Developer and the Association reserve the right to install erosion
control structures or devices in the Common Areas and to enter into and on the Common Areas to
remove dead, decayed or dangerous trees or vegetation or to prevent imminent hazard or the thteat of
fire.
The Association shall enforce the provisions of this Section. Such enforcement rights shall
include the right to enter into and on the ConunOD Areas in order to monitor compliance with and
enforce the terms of this Section. including the right to repair any damage to the Common Areas. Any
Owner that violates the provisions of this Section shall reimburse the Association for the costs incurred
by the Association (a) to enforce the provisions ofthis Section, including, but not limited to, reasonable
attorney fees, and (b) to repair any damag~ to the Common Areas, including the replacement of any
destroyed or damaged trees or vegetation. This reimbursement amowu shall be deemed to be a special
~$eS$ment to be paid and collected in accordance with the provisions of these Covenants.

owners to respect the fOllowing with regard to the maintenance of trees and shrubs:
(i) The owner of the dominant real estate adjacent to the area between the street and the

the maintenance and removal or the tree or shrob if such removal is necessary.

This letter serves to acknowledge receipt of a transmittal containing the above-mentioned
project. After reviewing the plans, the Highway Department has the following comments:
1. The Highway Department has no objections to the amendments made to the Primary
Pial Due to the City of Cannel purchasing the Lacy property located to the west, the stub
street Is not needed.
2. Since the construction plans for Shelbome Park. Section 1 have been approved with the
Queensland Way stub street being installed, revisions to the plans will be needed. The
construction plans will need to be reviewed to verify that all grades, elevations ete... will
not be affected by eliminating the stub street. A letter will be needed from Stoeppelwerth
& Associates verifying the plans have been reviewed and all issues with the elimination
of the stub street have been proper1y addressed.
