DEPARTMENT REPORT
MONDAY, SEPTEMBER 23, 2024
(V) Wishart Accessory Building Variance.
The applicant seeks the following development standards variance approval for a gazebo:
5. Docket No. PZ-2024-00137 V UDO Section 5.02 (B)(3) The combined square footage of
the Ground Floor of a Private Garage and/or Accessory Building shall not exceed 75% of the
Ground Floor Area of the Principal Building; 133% requested.
The 0.97-acre site is located at 11642 Rosemeade Drive (Rosemeade Commons, Lots 3 & 4). It is zoned
R1/Residence. Filed by Andrew Wishart, owner.
General Info:
• The Petitioner seeks approval for a new pergola/gazebo.
• Variance is requested for accessory structure square footage.
• The site is located in Rosemeade Commons subdivision; HOA (Homeowner’s Association) approval has
been granted.
• Surrounding this site are single family residential homes and a stormwater detention pond area.
• The pending accessory building permit is B-2024-00431.

Variance Requested:
Accessory Structure Size -
• The UDO requires the combined square footage of the Ground Floor of a Private Garages and/or Accessory
Buildings shall not exceed 75% of the Ground Floor Area of the Principal Building; and 133% requested.
• The dimensions of the gazebo/pergola will be 16’ wide by 26’4” long.
• It will be 12’5” tall to the roof peak, and it will be made of wood with an asphalt shingle roof, with colors
and materials to match the existing garage.
• It will be placed between the home and the existing garage/outbuilding, near the swimming pool.
Remaining Review Comments:
• All Planning/Zoning review comments have been addressed.
Final Comments:
• The Planning Dept. supports the variance request because the lot is fairly large, compared to the other lots,
and can easily accommodate all of the different types of accessory structures and uses – pool, pergola,
garage, etc.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and
with adoption of the Findings of Fact submitted by the Petitioner.
