At the meeting held Monday, February 26,2007, the Carmel Advisory Board of Zoning Appeals Hearing Officer
took the following action regarding the Dev,lopmental Standards Variance (V) filed by you for the property located

at 11815 Eden Glen Drive.
APPROVED: Docket No. 07010015 V Development Standards Variance for rear yard setback.
Please be advised that per Section 30.05.05: Time Limit of the Zoning Ordinance, the aforementioned Development
Standards Variance approval is valid for one (1) year. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approval must have
been received and approval granted by this Department. The expiration date of the approval is February 26, 2008.
When applying for applications for permits regarding the improvements contained within this approval,
please include a copy of this letter with your application materials in order to assist the Department's review.

The meeting was held at 5:30 PM in the Caucus Rooms of City Hall, Carmel, Indiana on Monday,
February 26,2007. The Hearing 'Officer was Leo Dierckman.

Department of Community Services Staff in attendance was Angie Conn. Jolm Molitor, Legal Counsel,
was also present.

The applicant setks the following development standards variance approval:
Docket No. 07010015 V Section 7.04.03.D rear yard setback
The site is locate~ at I 18 I 5 Eden Glen Dr., and is zoned R- I/Residenee.
Filed by Garry d. Lyons.

Present for the Petitioner: Garry Lyons, owner of the property. The lot is odd shaped and placement of
the garage on the lot will come ~ithin thirteen feet of the rear property line. Tn R-I the setback should be
20 feet.

Mr. Dierckman had reviewed tile plans.

The Public Hearing was closed.,
Mrs. Conn gave the Department Report. The Department recommended positive consideration. The
request is for a ditference of se.,:en feet. If this were a detached garage, it could have been five feet trom
the property line. There are diff~rent standards for attached and detached garages.
