Info Only INSTRUCTIONS FOR FILING NON-ENFORCEMENT REQUESTS FOR INDIVIDUAL TRACTS The following are instructions for the completion of the Non-Enforcement form for individual tracts. A. The Non-enforcement Request and Non-enforcement Information form shall be submitted to the Hamilton County Surveyor’s Office ten (10) days prior to the Hamilton County Drainage Board meeting. The Drainage Board meetings usually take place on the 2 nd and 4th Monday of each month. B. Request shall be on the standard form, as supplied by the Surveyor’s Office. C. The form shall be completely filled out with the following information: 1. Name of individual, firm, partnership or corporation owning the tract. 2. County parcel number of tract as shown in the Hamilton County Auditor Office. 3. Recording information for Deed of current owner. (From Hamilton County Auditor or Recorder’s Office. 4. Name of Regulated Drain. 5. Purpose of encroachment (driveway, structure type, etc.) 6. In the presence of a Notary Public, date and sign by the individual, officer of firm or corporation, or general managing partner or partnership. D. A copy of a site plan, plat or engineered drawings showing what structures are proposed to encroach along with distances from the proposal structures to the drain in the Hamilton County Drainage Easement shall be submitted with the application. E. The Surveyor shall fill in the remaining items: a). “Subject to _______________” (Other conditions determined by Surveyor). b). Distance from the top of bank/center line of tile. c). Side of top of bank/center line of tile F. This form must be signed by and have printed name of owner of record as shown on the warranty deed from the Hamilton County Auditor. G. I have a?ached a quick dra? with a plan for (5) 6’ ht ‘green giant’ arborvitae at 10-12’ spacing with placement either centered between the property line and pool or at least 5-7 from the property line.. That is the species of choice and what Kevin Rider was referencing as well in the mee?ng. The conditions are the Petitioner passing a final inspection of the pool, and also making a best e?ort to install landscaping in the southeast corner of the lot (which will also need approval from the Hamilton County Surveyor’s O?ice & the Carmel Planning/Zoning Dept. due to the regulated drain easement.) The goal of the additional landscaping is to provide some privacy/screening between the pool on Lot 12 and the house on Lot 10. Sam – Will the County approve/allow any plantings in the RDE on Lot 12, at the southeast corner of the lot? And, if so, can those we arborvitae shrubs and/or other types of plants? Daren – What plant species do you recommend get planted at the southeast corner of Lot 12? And, also how many plants would be acceptable? Her permit is also expired on 2-24-24. There are additional fees due for this prior to scheduling. Lastly, I do not have anything from the County stating they have conducted their final inspection. The last time I talked to inspector Clara Furst she had not been back out but wanted to join us when we conducted our final. Please let me know if you want the expired permit fee waived. I believe it’s around. Below is a breakdown of the current fees which also includes the current amendment Here is what would be due: $247.50 for extension fee (B-2022-00688) $76.00 for re-inspection (B-2022-00688) $207.25 for plan amendment (B-2024-01431) Please let me know if these fees should stand?” I would like to reach out to the County to make sure they are able to sigh off as well, If we all agree that’s needed? Yes, a Residential Plan Amendment is needed for the existing location of your pool pump equipment since the original plans submitted with your original building permit back in 2022 had a different location for your pool pump equipment. It would be in your best interest to apply for the Residential Plan Amendment prior to your BZA hearing on Oct. 28. You would submit your online application here for a Residential Plan Amendment.
