Explanation of why variance/waiver is being requested: Request allowance for pool equipment to remain located on the east side of the home and encroach into the 10-ft Side Yard Setback. Retaining wall is filled with gravel, instead of grass/sod, so the retaining wall is considered a part of the pool's decking/patio. Pool permits obtained by contractor A and pool equipment was not installed according to initial permit drawing. Pool equipment is on the same side of the property as the A/C unit for the home. The pool equipment registers less decibels than our A/C unit. We were unaware this was a violation until 8 months after the pool equipment was installed and the equipment is not able to be moved at project completion. Contractor B installed the patio and the retaining wall that was deemed a requirement by Hamilton County. Contractor B spoke with members of the City of Carmel and Hamilton County on our property in May 2024 when the decision was made that we must return our land grade after the pool had been installed. All parties discussed the retaining wall as the means to return the land to previous grade and contractor B constructed the wall the following day. As homeowners, we hired professional contractors to obtain permits and build a pool and patio according to code. Due to many unforeseen circumstances of the construction process, changes were required on the project and we entrusted our contractors to represent us and build the project according to all codes.
