Re: BZA Docket Nos. PZ-2024-00134 V; -00135 V; -00136 V: Beck Residence Variances.
Dear Mr. Beck:
At the meeting held on Monday, September 23, 2024, the Carmel Board of Zoning Appeals Hearing Officer took
the following action regarding the Development Standards Variances (V) request filed by you for the property
located at 430 1st Ave SE:
APPROVED WITH CONDITIONS: Beck Residence Variances - Development Standards Variance approval
for:
• 35% Maximum lot cover allowed, 38.3% granted,
• Sideyard Setback - a swimming pool, hot tub, or its deck or equipment shall be set back a minimum
of the greater of the following: 10-ft from the side lot line and rear lot line, or be 3-ft from any
easement; 5.7-ft side setback from lot line granted,
• Window wells cannot project more than 24” into a required yard, 60” projection granted, and
• CONDITION: The Petitioner provides payment into the Stormwater Fund/Fee.
Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Development
Standards Variance approval is valid for three (3) years. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approval must
have been received and approval granted by this Department. The expiration date of the approval is September 23,
2027.
