Considering the unexpected opposition, the Evangelical Baptist Missions has decided to
revise its plans in order to proceed. Consequently, pending the determination of the manner in which
the plans will be revised, we are requesting that (i) the request for plat and covenant vacation be
tabled and that, therefore, we not proceed before the Subdivision Committee on September 3,2002,
and (ii) the request for the use variance be tabled and, therefore, that we not proceed before the
Board of Zoning Appeals on August 26, 2002.

Petition against changing the R-I Zoning of all the real estate within Shelbome
Greene, Lot 331, Section 8, Secondary Plat, of which was recorded within the Recorder
of Hamilton County, Indiana, on July 27, 1999, as Instrument #199909944446.
The Board of Directors ofShelbome Greene Community Association (SGCA)
notified all the residents of Shelbome Greene (330 homes) via a supplemental newsletter
of the application from Evangelical Baptist Missions (EBM) for changing the current R-l
zoning of the above referenced real estate currently owned by Davis Homes.
Immediately, the homeowners directly bordering the referenced real estate vehemently
objected to the zoning change. Many other homeowners located in the Village portion of
the SGCA also objected to the applied for zoning change. The objections to the zoning
change are as follows:

Homeowners directly bordering the real estate paid to Davis Homes a
Lot Premium ranging from $6,000 to $12,000 and did so knowing the
bordering real estate to the south was zoned Residential (R-I).
The proposed Evangelical Baptist Missions facility to be built upon the
real estate is, in effect, a commercial building with a parking lot and
about 55 parking spaces wrapping around the building on three sides
(south, east and north). Shelbome Greene residents closely border the
proposed facility on the north side and are threatened with a potential
reduction in property value resulting from the construction of a
commercial facility.
Proposed office hours for the EBM facility are 8:00 a.m. to 5:00 p.m.
with no assurances of non-operation following these hours. Nightlights
in an operating facility and the installation of parking lot lights are
definite objections on the part of SGCA homeowners.
Potential growth and expansion plans are uncertain and would only
enhance the commercialization of the real estate.
Shelbome Road traffic has grown making the intersection of Shelbome
Road and 96th Street a definite danger zone for vehicles turning in all
directions at the intersection. The additional traffic generated by
employees of Evangelical Baptist Missions would worsen the situation.
The SGCA is curious to learn about any potentially detrimental effects
on the existing watershed that would be caused by the proposed new
construction.

zoning of the real estate described in the first paragraph of this petition.

Dear Laurence:
Enclosed are proposed Findings of Fact, together with a Certificate of Plan Commission
Action certifying the vacation of the plat and the covenants. Also enclosed for your reference is an
excerpt from the Section 8 plat of Shelbome Greene. Regarding the need to also appear before the
Hamilton County Commissioners, my thoughts are as follows:
1. The plat created and dedicated the 45' half of Shelbome Road adjacent to Lot 331;
2. When the plat is vacated, the dedication will be vacated, and there will be no roads for the
County Commissioners to vacate; and
3. In order to protect the County's interests, the plat vacation can be contingent upon the
separate dedication of a meets and bounds legal description representing the required
right-of-way. I will provide this to you.

FINDINGS OF FACT
1. Conditions in the platted area have changes so as to defeat the original purpose of the plat and the
covenants because (i) the only lot within the plat ofShelbome Greene, Section 8 (the "Plat"), is Lot 331, comprising
over 2 acres, (ii) continuation of the Plat will prohibit the combination of said Lot 331 with adjoining real estate
for the development of a single use, and (iii) all owners of the land within the Plat have consented both to the
vacation of the Plat, and the Declaration of Covenants, Conditions, and Restrictions, if any, applicable thereto,
including without limitation, the vacation of the Declaration of Covenants, Conditions, and Restrictions of
Shelbome Greene dated October 25, 1995, and recorded as Instrument #9560988 in the Office of the Recorder of
Hamilton County, Indiana, together with any and all amendments and supplements thereto (collectively the
"Covenants").
2. It is in the public interest to vacate the Plat and Covenants because (i) all owners of the land within the
Plat have consented to the vacation of both the Plat and the Covenants, and (ii) by separate dedication, the owner
of the real estate shall dedicate the right-of-way ofShelbome Road created and dedicated by the Plat.
3. The value of that part of the land in the Plat not owned by the Petitioner will not be diminished by
vacation because all of the owners of the land within the Plat have consented to the vacation of the Plat and the
Covenants.
EFFECTIVE DATE
The vacation of the Plat and Covenants made the subject of this request shall be effective upon the
occurrence of all of the following events:
1. The acquisition of the real estate made the subject of this request by the Evangelical Baptist Mission;
2. The granting ofthe Use Variance, under Docket No. UV-150-02, by the Carmel/Clay Board of Zoning
Appeals;
3. The commencement of development and construction of the offices of the Evangelical Baptist Missions
made the subject of the request for said use variance under Docket No. UV -150-02; and
4. The dedication of the right-of-way of Shelbome Road vacated by the vacation of the Plat.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Plan Commission that Docket No. 93-02 PV is
granted, subject to any conditions stated herein in the minutes of this Commission, which are incorporated herein
by reference and made a part hereof.

Hello everyone:
Following are CTRWD comments on the agenda items effecting our sanitary sewers or service
area for the July 17 TAC meeting. Please feel free to copy and distribute this email or
attach it to your meeting minutes. We have also created a new page on our website linked
to the "Construction" page where we have posted all CTRWD TAC comments from 2001 and 2002
meetings held to date. We will continue to add to this page every month so please let
everyone know they can view our comments online now too.
Sedgwick Subdivision (Secondary Plat & Construction Plans)
The plans received by the District do not show the most recent version of the
specifications. Final revisions will be required. Building permits should NOT be issued
unless the District has issued connection permits.
Lakeside Park Subdivision (Primary Plat)
The District has not received any plans for this proposal. Building permits should NOT be
issued unless the District has issued connection permits.
Shelbourne Greene, Section 8, Plat Vacation
The District has no comments on the re-plat unless it effects the sanitary sewers in
development.
Lakes at Hayden Run, Section 1, Block A (Special Use)
The plans received by the District do not show a sanitary sewer connection or contain the
District's Sanitary Sewer Specifications. Revised plans need to be submitted showing a
sanitary connection and the District's specifications. Building permits should NOT be
issued unless the District has issued connection permits.
Please remind all TAC applicants to provide plans directly to the District at our main
office address in care of Andy Kern at:
