Docket No. 92-02 CA; Merchants' Pointe, Lot # 6- Commitment Amendment Petitioner seeks Commitment Amendment approval to revise the retail square footage and number of tenants permitted on Lot 6 within the Merchants' Pointe Subdivision. The site is located at 2325 Pointe Parkway. The site is zoned B-8/Business. Filed by James J. Nelson of Nelson & Frankenberger for The Linder Company. The applicant is proposing to amend the zoning commitments for lots 6 within the Merchant's Pointe commercial subdivision. Please refer to your informational packet distributed with the agenda last week. It includes the original commitment and rendering of the building as approved by the Special Studies Committee on August 6th. The Department has no o1>jection to the request. However, as the Commitment was made attendant to the rezone ofthe property and the Department would like to have the applicant provide the Commission with the position of the Carmel City Council on this request. To that end, our primary concern is whether the amount of office space committed to by the applicant was critical in the decision made by the legislative body to rezone the parcel B-8/Business. The Department recommends that this item be forwarded to the Special Studies Committee on September 3rd for further discussion. However, if there are no comments or concerns to be discussed by the committee the Department recommends final action at this meeting. Note: Taking final action on this item this evening will require a vote to waive the Commission's Rules of Procedure that would otherwise direct the item to Committee. e. ....J
