The AMTA policy not only provides an exact description of what is covered and what is not covered, it also sets out your obligations as an insured and, where appropriate, the obligations of others involved with you. The Chicago Jnsurance Company and Marsh Affinity Group Services are committed to providing you efficient claim service. You, as an insured AMTA member, trigger this service when you report a claim quickly and accurately. III the eve"t of an illcident which may result in a claim, an actual claim, or your receipt ofslIiI papers arisillg out o/your services as a Massage Therapist, please follow the procedures outlined below: Notices of each incident, claim or suit must be sent immediately to: Chicago Insurance Company, Professional Liability Claims - c/o Marsh Affinity Group Services, a service of Seabury & Smith 1440 Renaissance Drive. Online: www.seaburychicago.com Your claim notice should include the following: Membership In Number; Join Date/Expiration Date; Your name, address, and phone nwnber; A copy of your Certificate of Insurance fonn - this will include important infoffilation regarding your coverage; The date or period of duration (start date/finish date) of the professional service in question and the date you first became aware ofthe problem or potential problem; A brief description of the problem; Copies of any letters of demand and any legal papers (i.e.: summons and complaints, notices of arbitration, etc.) which you have received; Client 1ntake Fonn. Do not discuss the claim with any adverse party or their representative. Do not admit any liability or pay any portion of alleged damages. Do, not attempt to handle the matter yourself. Anyone of these actions may void your coverage. (~f you waive your fee, or any part of it, in conjunction with a dissatisfied customer and do not admit any liability, the terms of your coverage may not be compromised. Send us a notice of any such incident immediately.) You will be contacted by a representative of the Chicago Insurance Company's Claim Department. This representative, who specializes in the handling and adjusting of Massage Therapists' professional liability claims, will confinn receipt ofthe loss notice directly to you, provide a company claim number for all future correspondence, refer to legal counsel if necessary, and discuss further handling of the matter with you. , NOTE: Additional insureds are not automatically tramil/erred to your new policy at the time o/your renewal. ANSWERS TO COMMON INQUIRIES What is my Scope of Coverage? Your coverage under the AMrA Professional Liability Insurance Plan is triggered by your '''Scope of Practice" which is defined as "Therapeutic Massage and Body Work." The AMTA Professional Liability Insurance Plan policy is not intended to be procedure of modality specific... but instead, [he policy was written such a way that it will cover you for any procedures you are qualified to perfonn as a massage thempisL Do I Need a License to Practice? If a License is required in the state or Location in which you current practice, you must be functioning within the scope of that licensure. However, in some states, there is not certification, registration or licensing required. 1n this case, the AMTA Professional Liability 1nsurance Plan policy would respond for those activities within your education and training as a massage therapist. Is my Coverage Affected by Zoning Ordinances? Actually, there is no correlation between Zoning Ordinances and Professional Liability coverage which would be covered under the AMTA policy. In other words, jf an individual is found to be in violation of city or state zoning ordinances, but is sued for Professional Liability, the AMTA policy would provide Professional Liability coverage for the individual. What is Additional Insured Coverage? This extensio~ of liability coverage is utilized when contracts you may have with hotels, landlords, h~alth & fitness clubs, etc. require you to name these entities as additional insureds. Please read your contracts carefully to be certain that you are requ1red to add these entities. It is not necessary to name yourself or your business name as additional insureds, as you and your business are automati- cally insured so long as you are a member of AMTA in good standing. It is also unnecessary to name any other AMTA member with whom you may do business, as they are automatically covered by the AMTA plan. The insurance contract should not be extended to add employers as additional insureds. Employers should purchase their own policies to cover regular business activities.
