I just got off the phone with our legal department and after some research, it was determined that the development standard variance (PZ-2024-00181) for lot coverage was not required. The Enclave of Carmel subdivision was granted a variance in 1993 for the entire subdivision to have a 45% maximum lot coverage. Because of this, we will mark the variance as void and proceed with the required replat and apply the amount paid for the previous filing toward the replat petition (PZ-2024-00225). I’m not sure why the HOA states there are no rear building setback lines as they are shown in our record of The Enclave of Carmel subdivision plat from 1991. Don, if you could provide context on this, that would be very helpful. Because the building setback lines are platted, the only way to adjust these lines is through the replat process. It should be a relatively easy process, assuming your HOA is okay with the encroachment into the drainage & lake maintenance easement. Considering the deck footprint has been on site and you are just covering it, I don’t anticipate any issues. Please contact me with questions as you work with a surveyor to develop your proposed plot plan with the revised building setback line. Please also work on a letter of approval of this new plot plan with Don. Which would make sense considering how close all the houses are to the easement and not being on the plot plan that I have. How do I get some clarification on this?
