Dear Mr. Nelson,
At the meeting held Monday, October 29,2002, the Carmel/Clay Advisory Board of Zoning
Appeals took the following action regarding the Development Standards Variance filed by you on
behalf of Merchants' Pointe Associates, LLC, for signage to be located at 2325 Pointe Parkway:
APPROVED: Docket No. V-170-02, a Development Standards Variance petition of Section
25.7.02-8(b)(i): Number & Type in order to establish three (3) ground floor tenant
Identification Signs.
The Board voted five (5) in favor, zero (0) opposed, thereby approving the petition.
*Wben applying for Sign Permits for this structure, please include a copy of this
letter with your application materials in order to assist the Department's review.
Please be advised that per Section 30.5.5: Time Limit of the Zoning Ordinance, the
aforementioned Development Standards Variance approval is valid for one (1) year. By that
time, either continuous construction of sign improvements must be underway, or a written
request for a one-time, six-month extension of the approval must have been received and
approval granted by this Department. The expiration date of these approvals is Tuesday, October
28,2003.

As a further description of the signage request for the OfticelRetail building, Lot 6
Merchants Pointe, please accept the following: the request is for three (3) tenant signs on the
north elevation of the building, as depicted on the drawings now on file. Each sign will be self-
illuminated, white face, with dark bronze or black returns. The size of the signs win be as
permitted by the Carmel Sign Ordinance. No ground signs are requested at this time, but if later
requested will be within the provisions established by the sign ordinance. If you should have any

This review is in response to a drawing submitted to this office on September 21, 2001 by Mr. Brad SchoefI We
apologize for the delay in responding to this revised drawing. We offer the following comments:
GENERAL INFORMATION
1. Board of Public Works and Safety Requirements:
. Water and Sanitary Sewer Availability. To my knowledge, this approval has not been requested.
. Any permanent improvement to be installed within dedicated right of way or dedicated easements. This
approval would require a Consent to Encroach Agreement between the Owner and the City of Carmel.
I am also including a schedule of Board of Public Works and Safety meeting dates and agenda deadlines for
your use. Please use the Engineering Department deadlines for submissions to the Board.
Any submission to the Board requires prior approval by the Carmel Clay PIma Commission and/or the
Board of Zoning Appeals and completion of review by the Technical Advisory Committee. AU written
requests to be pltree on the Board's ogemla /llUSt incwde the appropriote Docket Number and the dote (or
dotes) of approval by the Plan Commission and/or tl,e Board of Zoning Appeals. According to my records,
tl,is project received Plan Conunission approval on April 17, 2001, Docket Number 200-00 ADLS. Since a
year hiB passed since Plan Commission approval, is tile approval sliU valid?
2. TAC. ReviewlDrawings submitted for approval:
We request that all comments and comment letters generated by this office be answered in writing and be
accompanied by a drawing reflecting requested revisions. Final drawings will not be approved for
construction until all Engineering Department and Utility Department issues have been resolved. The design
engineer must certify all drawings submitted for fInal approval. This office will require a minimum of fIve-
sets of drawings for approval after all issues have been resolved The drawings will be stamped as approved
and will be signed by the City Engineer and by the Director of Carmel Utilities. The Owner will receive one-
set which is to be maintained on the construction site at all times. Carmel Utilities will receive mo-sets, our
Public Works Inspector will receive one-set and one-set will be maintained in the Engineering Department
3. Please be advised that any installation of signs, walls. irrigation systems, etc. within dedicated right of way or
dedicated easements will require a Consent to Encroach Agreement with the City of Carmel.
4. Carmel Utilities should be provided drawings for review of water and sanitary sewer issues. They will
provide a separate review of the project.
5. Carmel Utilities does not subscribe to "Holey Moley" and should be contacted directly fro all water main and
sanitary sewer main locations.
CONNECTION FEES
6. It is our understanding that this development is to be a general office type facility. Based upon the
Equivalent User Contribution Multiplier tables from our Utility ordinance (Chapter 9~35 for water and
Chapter 9-200 for sanitary sewer), the conversion factor for offices is 0.5 EDUs per 1,000 square feet of
office area. Based upon the data on the drawing submitted, the following calculation would apply to this
development:
Two story building @ 15,000 square feet per floor = 30,000 total square feet
30,000 square feet @ 0.5 EDUsll ,000 square feet (office classification) = 15.0 Total EDUs

8. There are solid black circles on the outside of the building. Two are labeled as light pole base and light Are
we to assume the other two are the same?
9. Label the Pointe Parkway right of way line.
10. It appears that many of the parking spaces for this development encroach upon utility easements. These
encroachments will require a Consent to Encroach Agreement between the Developer/Owner and the City of
Carmel.
11. The southeast corner of the building appears to be on the 60-foot gas line easement Care must be taken to
assure the building does not encroach into this easement.

12. Label storm sewers, pipes and inlets (length, size, type, etc.) and indicate if existing or proposed.
13. There should be a legend on this sheet to identity the various elements shown on the drawing (storm sewers,
sanitary sewers, lights, etc.).

14. The 8-inch sanitary sewer main and manhole (structure E) does not appear to be in an easement. Is there an
easement for this line?
