RE: Keystone Office Park & Commitments to Dedicate LaSalle Street road right of way
Ms. Tempel:
The City of Carmel has jurisdiction over zoning matters within the Township of Clay, within
Hamilton County, Indiana. The Department of Community Services has determined that the current
office uses are permitted and are conforming uses within the B-3/Business district, and to the best of
our knowledge no apparent zoning or building code violations exist on the property. Please note that
there are recorded commitments relating to the easternmost building/site Plan Commission approval,
which basically state that the proposed LaSalle Street right of way (25-ft) will be dedicated (within
12 months) following the written request of the City Engineer. If the written request ever occurs, the
site (the east building setback) will be legal non-conforming and no additional variances will be
needed for building setback relating to the dedication of right of way and the construction of LaSalle
Street.

Please be advised the property located at 3021-3105 East 98th Street, Indianapolis, Indiana 46280,
(commonly known as Keystone Office Park) is zoned B-3/Business within the State Road 431
Overlay. according to the Official Zoning Map of the City of Carmel, Hamilton County, Indiana.
The City of Carmel has jurisdiction over zoning matters within the Township of Clay, within

our knowledge no apparent zoning or building code violations exist on the property. Please note that

construction of LaSalle Street.
The pertinent sections of the zoning ordinance that may apply to the said Property are B-3/Business,
State Road 431 Overlay, Appendix A: Schedule of Uses, Landscape Bufferyards (Chapter 26.04),
and Parking Ordinance (Chapter 27), which can be downloaded as a .pdf file on our website at

represents what was approved. Also below is a snapshot graphic of the zoning map of the area

Dear Mr. Nelson:
This will acknowledge receipt of your July 9th letter regarding the revision requested by our Department of
Community Services. Assuming this will be the only revision to the plans submitted and certified by
Weihe Engineers on June 25, 2002, we offer the following:
1. AIl appropriate sheets in the set of drawings submitted for this project need to be revised to reflect
the above revision requested by our Department of Community Services. It appears that this
revision will affect Sheets 3, 4, 5, 6 and E-l. Therefore, the four sets of drawings submitted to this
office on June 25, 2002 will be obsolete.
2. Board of Public Works and Safety approval of Sanitary Sewer availability for this project expired
on June 21, 200 1. You will have to resubmit your request for availability to the Board. Be
advised that all Plan Commission and/or BZA approvals must be obtained frior to any request to
be placed on the Board's agenda. I believe this project was on the July 16 Plan Commission
agenda for public hearing. I assume this was probably forwarded to the next available Special
Studies Committee for review, so approval by the Plan Commission is probably at least a month
away?
3. When the project has received Plan Commission and/or BZA approval, received all BPWS
approvals and the drawing has been approved by this office, the following remaining requirements
must be satisfied:
. Provide this office with 4-sets of certified and revised construction drawings. The
drawings submitted for approval must correspond to the most recent set submitted and
approved by our office. The City Engineer and the Director of Carmel Utilities will
approve and sign the drawings. One approved set is to be maintained on the construction
site at all times. One set is distributed to Carmel Utilities; one set to our Public Works
Inspector and the final set is maintained in the Department of Engineering.
. Payment of Sanitary Sewer Connection Fees in the total amount of $7,191.00. The check
is payable to the City of Carmel. Upon payment of the Sanitary Sewer Connection Fee,
you will be issued a Sewer Permit. You will be required to designate a bonded
plumber/excavator when you apply for your Sewer Permit. This is the person who will
make the outside sanitary sewer service line connection from the building to the main.
. When you are issued the Sewer Permit, you will be able to schedule the pre-submittal
meeting with our Building and Code Enforcement.

requested a revision to the drawings and a copy is enclosed. The revision is limited to the
following: The right-of-way for which a Commitment has been made has been identified on the
drawing as proposed 25' public right-of-way, and the parking area and landscaping previously
shown have been removed from the 25' strip. I wanted you to be aware of this, and should you

On July 16,2002, Sheridan Realty (Amerivest), the Owner of Keystone Office Park (98th
and Keystone), will present to the Carmel Plan Commission, it's DP/ADLS Application
requesting approval to construct the final office building in Keystone Office Park. Enclosed
please find an informational booklet describing the request. The proposed office building will be
single story in height, and will mirror in all respects the existing office building as to design
(contemporary with classical accents), coloration (beige), and building materials (brick). Also
find enclosed the final revised site plan resulting from meetings with the Department of
Community Services and representing the commitment to dedicate right-of-way for the future

uplands. Permeability is moderate in the subsoil and the substratum. Available water capacity is
high. The main soil features that adversely affect engineering uses of this soil are moderate
potential for frost action, moderate permeability, and moderate shrink-swell potential. This soil
has severe limitations for local roads and streets. The base material needs to be strengthened with
suitable material.
Additional information about soils is available in the "Soil Survey of Hamilton County".
The engineer and/or developer should consider the need for an onsite soils investigation.

Dear Mr. Nelson:
On October 5, 2000, this office issued a letter to Mr. Lenard H. Wolfson. This letter informed Mr. Wolfson
that this office had reviewed and approved the revised drawing for this project, contingent upon the
owner/developer providing our office with a written commitment to formally dedicate the 25-foot access
easement located across the east side of the property. We requested that the formal dedication be
completed as soon as possible. Now that this project is being resubmitted for review, we are again
requesting this commitment and dedication. In addition, we offer the following additional requirements:
1. Weare not anxious to start the review process for this project from scratch, particularly since the
previous review resulted in our approval of the drawing. Therefore, we request that Weihe
Engineers either, a) certify that the drawing submitted for TAC. review is identical to the
drawing approved by this office on October 5, 2000 or b), if not identical, give us an itemized
listing of changes made to the original approved version.
2. Board of Public Works and Safety approval of Sanitary Sewer availability for this project expired
on June 21, 2001. You will have to resubmit your request for to the Board. I am enclosing a copy
of Board of Public Works and Safety meeting dates and agenda deadlines for your use. Be
advised that all Plan Commission andlor BZA approvals must be obtained prior to any request to
be placed on the Board's agenda.
3. When the project has received Plan Commission andlor BZA approval, all BPWS approvals and
the drawing has been approved by this office, the following remaining requirements must be
satisfied:
. Provide this office with 4-sets of certified construction drawings. The drawings
submitted for approval must correspond to the most recent set submitted and approved by
our office. The City Engineer and the Director of Carmel Utilities will approve and sign
the drawings. One approved set is to be maintained on the construction site at all times.
One set is distributed to Carmel Utilities; one set to our Public Works Inspector and the
final set is maintained in the Department of Engineering.
. Payment of Sanitary Sewer Connection Fees in the total amount of $7,191.00. I am
enclosing a copy of the fee calculation with this correspondence. The check is payable to
the City of Carmel. Upon payment of the Sanitary Sewer Connection Fee, you will be
issued a Sewer Permit. You will be required to designate a bonded plumber/excavator
when you apply for your Sewer Permit. This is the person who will make the outside
sanitary sewer service line connection from the building to the main. I am enclosing a
list of our current bonded phunbers/excavators. You may use any contractor you choose.
