Dear Mr. Kemper:
At the meeting held Monday, May 22,2006, the Carmel Advisory Board of Zoning Appeals took the following action
regarding the Special Use application (SU) and the Development Standards application filed by you for the property
located at the northeast comer of 1061h Street and Shelbome Road.
APPROVED: Docket Nos. 06040011 SU and 06040012 V, Special Use application for special uses and
Development Standards application for building height with the following Conditions:
1. Dedication of road right-of-way
2. Connectivity from the church to the perimeter path, with Phase I and Phase II construction
3. Construct a 3 to 4-foot high berm, approximately 20 to 25-feet wide, and approximately 150 feet
long during Phase I construction, along the north property line
4. As shown on the amended landscape plan: planting 8 to 10-foot Norway Spruce or Canadian
Hemlock, and planting ornamental trees, all on top of berm, all mulched
5. No improvement/construction zone between the berm and English Oaks Subdivision boundary
6. Preservation of existing trees within the English Oaks common area where some tree limbs may
extend onto the church property.
Please be advised that per Section 21.02.07: Time Limit of the Zoning Ordinance, any person to whom a Special Use
is granted by the Board, under the procedures set forth in this chapter, shall have commenced continuous
construction of said Special Use or implemented said Special Use within one year of the date of the granting of the
approval or said approval shall become null and void. The expiration date of the approval is May 22,2007.
Please be advised that per Section 30.05.05: Time Limit of the Zoning Ordinance, the aforementioned Development
Standards Variance approvalis valid for one (1) year. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approvals must
have been received and approval granted by this Department. The expiration date of the approval is May 22, 2007.
When applying for applications for permits regarding the improvements contained within this approval,
please include a copy of this letter with your application materials in order to assist the Department's review.
