Included in this packet are the documents requested to support the increase of lot coverage to 48% at 10419
High Grove Drive. The increase in lot coverage is needed in order to install an in-ground swimming pool and
surrounding concrete deck. Previously, a variance was requested and approved for the addition of a back patio.
That variance allowed for 43% lot coverage.

Statement of Request
We are seeking BZA Variance approval from UDO Section 2.04- which specifies a maximum lot coverage
allowed of 35% in an S1/Residence.
Through a variance applied for by the previous owner, PZ-2021-00084 V, 43% lot coverage was granted. We
are requesting the maximum lot coverage be increased to 48% in order to accommodate the installation of an
in-ground swimming pool and perimeter concrete deck.
Statement of Support
The installation of an in-ground swimming pool is an amenity that the Horn's were planning on adding when
they purchased the home in 2023. At that time, they were unaware that a variance would be required in order
to do so. The addition of a swimming pool would add to the overall enjoyment of the backyard area. This would
also bring the home amenities in line with homes in the neighborhood as the majority also have in-ground
swimming pools and a backyard entertaining area.

I am pleased to inform you that the Architectural Review Committee has approved your request
for the following:
Install new in ground liner pool with concrete deck and vinyl pool cover. The
pool deck will be installed to have a 2% slope and the turf and the landscaping
beds touching the bed will have a gentle slope. Install a hot tub spa recessed 2'
below the concrete deck leaving 12" visible above the concrete deck. Install a
retaining wall and columns. Approval based on documentation submitted from
Aspen Outdoor Designs.
It is your responsibility to obtain any necessary permits and follow the guidelines mandated by
the county, city, or state and to ensure all improvements are within your property lines and
setbacks. Please be aware that you are responsible for maintaining proper drainage in areas
affected by the work and for erosion control. Additionally, you will be responsible for ensuring
the streets are cleared of dirt and debris daily from this project.

CARMEL ADVISORY BOARD OF ZONING APPEALS

The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
The inground swimming pool will be secured by an automatic safety cover when not in use. Additionally,
the yard that the pool will be located in is secured by a fence with a locked gated entrance.
The use and value of the area adjacent to the property included in the variance will not be affected in a substantially
adverse manner because:
The homes adjacent to the property have similar swimming pools and spaces for entertaining
in their backyards. Therefore, this would only give these homes a more comparable property for
property valuating purposes.
The strict application of the terms of the Unified Development to the property will result in practical difficulties in the
use of the property because:
The homeowners would not be able to enhance their backyard to be on par with what the adjacent homes
offer in regards to backyard improvements. Therefore, this would put this property at a disadvantage in
regards to property value when compared to similar homes in the neighborhood.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No.
is granted, subject to any conditions stated in the minutes of this Board, which are
incorporated herein by reference and made a part hereof.
