The property owner would like to have a bus shelter near the front of the property to provide shelter
during inclement weather days while their school age children wait for the bus. The house sits almost
300 feet from the edge of the road. This would put the waiting point 200 feet closer to the bus pick up
point.
Variance Request
The property owner would like a variance from UDO Section 5.02 (B)(1)(a)(i) 25-ft Minimum setback of
an accessory building behind the principal building. We are requesting an accessory structure be
located 212 feet in front of the principal building.
Statement of Support
This is a 6ac parcel with a single family residence that will sit approximately 300 feet off the road. The
family has school aged children (ages 10 and 14) that ride the bus. This shelter would provide a place for
them to be protected from inclement weather while waiting for the bus. The structure will still be
outside of the right of way and the minimum setback distance. In the past couple of years several
similar requests have been approved for various reasons.
Additional Pertinent Information
The proposed bus shelter structure will sit behind proposed walls and landscaping mounds. The
structure will fit with the character of the house being built

1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
The accessory structure will still be outside of the building set back line, will not obstruct any views from the
neighbors and will follow the design theme of the home.

2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially
adverse manner because:
The accessory structure will be on private property and will not be accessible to the public. Visually it will
conform to the design styling of the home and therefore should not adversely affect neighboring properties.

3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the
use of the property because:
