(V) Narla Accessory Building Variance.
The applicant seeks the following development standards variance approval for a school bus stop shelter:
2. Docket No. PZ-2024-00150 V UDO Section 5.02 (B)(1)(a)(i) 25-ft Minimum setback of an
accessory building behind principal building; 212-ft located in front of the principal building
requested. The 6.29-acre site is located at 4130 W 131st St. (not part of any subdivision). It is zoned
S1/Residence. Filed by Brian Brown of Stoeppelwerth & Associates, on behalf of Shilpa & Om Prasad
Narla.
General Info:
• The Petitioner seeks approval for a school bus stop shelter in the front yard.
• Variance is requested for accessory building to locate in front of the house.
• The site is not located in any subdivision; HOA (Homeowner’s Association) approval is not required.
• The parcel of land is 6.29 acres in size.
• Please see the Petitioner’s info packet for more detail on the variance request.
Variance Requested:
Accessory Structure Front Setback -
• The UDO requires that an accessory building or use sits at least 25-ft behind the front face of the house
or primary dwelling.
• The minimum front yard setback for a primary structure is 40 feet.
• The bus stop shelter is proposed to be 94-ft from the front property line.
• The site plan shows 305.93-ft from the bump out of the existing home to the front property line, giving
us 211.93-ft that the bus stop shelter will sit in front of the principal building.
• The bus stop shelter will be situated behind proposed walls and landscaping mounds.
• The footprint will be 12’ x 14’, and it will be around 12’ tall.
Remaining Review Comments:
• All Planning/Zoning review comments have been addressed.
Final Comments:
• The Planning Dept. supports the variance request with the condition listed in the Recommendation.
• As part of the overall house/site project, the Petitioner still needs to dedicate street right of way, for the
Transportation Plan compliance that is required in UDO section 1.07, and the Petitioner is currently
working with the Carmel Engineering Dept. on that. The street right of way dedication petition will be
heard at the November 6, 2024 BPW (Board of Public Works & Safety) meeting.
• The Petitioner has already paid into the Thoroughfare Fund for what it would cost to construct the
multiuse path along their street frontage.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of this variance
request, with the condition of the Petitioner providing a copy of the approved, recorded street right of
way dedication document, and with adoption of the Findings of Fact submitted by the Petitioner.
