DEPARTMENT REPORT
MONDAY, OCTOBER 28, 2024
(V) Horn Pool, Lot Cover Variance.
The applicant seeks the following development standards variance approval for a swimming pool & patio:
4. Docket No. PZ-2024-00155 V UDO Section 2.04 Maximum 35% lot cover allowed,
Previously approved 43% lot cover from Docket No. PZ-2021-00084 V; 48% requested.
The 0.51-acre site is located at 10419 High Grove Drive (Windemere subdivision, Lot 57). It is zoned
S1/Residence. Filed by Alisa Cox of C-Ray Pools, on behalf of Evie & Gerald Horn, owners.
General Info:
• The Petitioner seeks approval for a new swimming pool and patio in the back yard.
• A variance is requested for lot cover.
• The site is in Windemere subdivision; HOA (Homeowner’s Association) has been granted.
• Surrounding this site are single family residential homes.
• There was a lot coverage variance granted in 2021 for a previous project - Docket No. PZ-2021-00084 V -
but the pool will put the site more out of compliance.
• Please see the Petitioner’s info packet for more detail on the variance request.
Variance Requested:
Lot Coverage -
• The UDO allows a maximum 35% lot coverage, and 45% is requested. This is an 10% increase.
• The pool and pool decking will add to the total lot coverage of the lot.
• The Windemere neighborhood has several existing stormwater detention ponds that accommodate for the
stormwater runoff.
• The Carmel Engineering Dept. would be supportive of up to 45% lot cover, but will not support 48% unless
additional measures are provided to offset the increase in hard surface.
Remaining Review Comments:
• All Planning/Zoning review comments have been addressed.
Final Comments:
• Due to the Carmel Engineering Dept. comment above, the Planning Dept. will only be supportive of 45% lot
cover at this time, and not 48% (unless additional measures are provided by the Petitioner to offset the
increase in hard surface and those are approved by the Carmel Engineering Dept.).
• The Petitioner plans to relocate the proposed pool pump equipment, so that it is at least 10-ft from the side
property line.
• Per the Petitioner, the pool pump equipment is a variable speed pump (Hayward VS900) that will operate on
a schedule so that it is quieter at night. The noise is less than that of a typical HVAC system.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of this variance request,
with the condition of only 45% lot cover (or providing additional measures as approved by the Carmel
Engineering Dept. to have 48% loc cover), and with adoption of the Findings of Facts submitted by the
Petitioner.
