The applicant seeks the following development standards variance approval for a new home: 10. Docket No. PZ-2024-00172 V UDO Section 2.10 Maximum 35% lot cover allowed; 41% requested. 11. Docket No. PZ-2024-00178 V UDO Section 2.10 Minimum 35-ft front yard setback allowed; 25-ft requested. The site is located at 426 Emerson Road (Johnson Addition, Lot 22). It is zoned R2/Residence. Filed by Robin Hines of Custom Living, Inc. on behalf of Mike & Therese Miclot, owners. General Info: • The Petitioner seeks approval for a new home with attached garage. • Variances are requested for lot cover and front setback. • The site is in Johnson Addition; however, an official HOA (Homeowner’s Association) doesn’t exist. • Surrounding this site are single family residential homes. • Please see the Petitioner’s info packet for more detail on the variance requests. Variances Requested: Lot Coverage - • The UDO allows a maximum 35% lot coverage, and 41% is requested. This is a 6% increase. • Most of the lot coverage consists of building and garage footprint, patio area, and driveway area. • Since the site will exceed the allowed lot cover percentage, the Carmel Engineering Dept. is also going to require on-site stormwater detention or payment into the Stormwater Fund/Fee. Front Setback - • The UDO allows a minimum 35-ft front yard building setback for the R2 zoning district. • A 25-ft front yard setback is requested, to match up with the platted setback for the Johnson Addition neighborhood. This is a 28.6% decrease. • The house exterior will be mostly brick and horizontal siding. • The window well will not encroach into the side yard setbacks. • Two trees are proposed to be saved in the front yard. Remaining Review Comments: • All Planning/Zoning review comments have been addressed. Final Comments: • The Planning Dept. supports the variance requests with the conditions of approval listed in the Recommendation below, since the Petitioner plans to work with the Carmel Engineering Dept. on outstanding items. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of these variance requests, with the condition of addressing all Engineering Dept. review comments and paying into their Stormwater Fund/fee if on-site stormwater detention cannot be provided, and with adoption of the Findings of Facts submitted by the Petitioner.
