CARMEL BOARD OF ZONING APPEALS HEARING OFFICER
DEPARTMENT REPORT
MONDAY, OCTOBER 28, 2024
(V) Scott Deck, Setback Variance.
The applicant seeks the following development standards variance approval for a deck:
12. Docket No. PZ-2024-00175 V UDO Section 2.08 Minimum 10-ft side yard building
setback allowed, 5-ft requested.
The 0.54-acre site is located at 11607 Eden Glen Drive (Eden Glen subdivision, Lot 2). It is zoned
R1/Residence. Filed by Bob Hartson of ProDeck LLC., on behalf of Chris & Amy Scott, owners.
General Info:
• The Petitioner seeks approval for a wood deck expansion in the side yard.
• Variance are requested for side setback.
• The site is in Eden Glen subdivision; however, we are told that an HOA (Homeowner’s Association) does
not exist.
• Surrounding this site are single family residential homes.
• Please see the Petitioner’s info packet for more detail on the variance request.
Variance Requested:
Side Setback -
• The UDO allows a minimum 10’ side yard setback; 5’ is requested. This is a variance of 5’ or a 50% change.
• The deck will include a privacy panel.
• Consent to Encroach approval has been granted by the Carmel Board of Public Works & Safety (BPW).
Remaining Review Comments:
• All Planning/Zoning review comments have been addressed.
Final Comments:
• The Planning Dept. supports the variance request.
• A support letter was received from the neighbor to the east – the Kingery residence at 11609 Eden Glen Dr.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and
with adoption of the Findings of Facts submitted by the Petitioner.
