The applicant seeks the following development standards variance approval for an additional sign: 16. Docket No. PZ-2024-00182 V UDO Section 5.39(I)(2)(a)(i)(1): One (1) Awning, Canopy, Projecting, or Wall Sign per Street Frontage; Two (2) requested. The 7.66-acre site is located at 4400 W. 96th Street (Mayflower Park subdivision, Lot 1). It is zoned I1/Industrial. Filed by Chris Badger of Badger Engineering on behalf of Performance Services Real Estate LLC., owners. General Info: • The Petitioner proposes a wall sign on the West elevation and a canopy sign on the East side. • Mayflower Park Dr. to the west is a private street, and 96th Street to the south is a public street. • The variance approval the Petitioner seeks is signs not facing a public street frontage. Two signs are requested (one to face west and one to face east). Regarding the west-facing sign, Mayflower Park Drive is a private street. And regarding the east-facing sign, it will not face any street, just the east property line. • The Plan Commission Committee just approved Docket No. PZ-2024-00162 ADLS Amend, for site and minor exterior building modifications. • The site is in Mayflower Park subdivision, and an Owner’s Association (OA) exists. • Surrounding this site are commercial and industrial uses. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Signs Not Facing a Public Street - • The UDO requires signage to face a public street right of way. Mayflower Park Drive is a private street. • The UDO also allows only 1 sign per public street frontage. This site only has 1 street frontage that is a public street right of way (96th Street to the south). The other street is a private street (Mayflower Park Dr.). And, 2 signs are requested. • Petitioner proposes to install 1 internally illuminated wall sign on the west facade (to face a private street). • The new entry vestibule on the east side of the building will also have a small canopy sign on it, and it will face the east property line (not towards any street). • Other (exempt) signs that will be installed include traffic directional signs and window graphics. • Most of the vehicle parking areas will be located just west of the building, just east of the building, and with some located just south of the building, too. • The site does not have a driveway off 96th Street; there is a driveway off Mayflower Park Dr. Remaining Review Comments: • If possible, please provide an approval letter or support letter from the Mayflower Park Owners Association. Final Comments: • The Planning Dept. supports the sign variance request. Even though Mayflower Park Drive is a private street, it still acts as a public street when it comes to signage for a site/building. • The number of bicycle parking racks is being adjusted to comply, so that a variance is not needed. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of the variance request with the condition of the Petitioner providing a copy of the Owners Association approval to DOCS before the Sign Permits can be issued, and with adoption of the Findings of Facts submitted by the Petitioner.
