I. Subdivision Regulations for which variance is being requested:
This subdivision variance is requested from Section 6.5.1 of the Subdivision Control
Ordinance which requires lots to have a minimum of SO' of frontage at the street right-of-
way.
2. State explanation of why variance is being requested:
This variance is requested because the land and residence owned by the Fausts, identified
on the Plat as Lot 54, does not have frontage at the street right-of-way.
3. State reasons supporting variance request:
The land owned by the Fausts is included as part of the Plat in order to avoid the
continuation of an unplatted area. The absence of frontage is a condition that existed prior
to and independently of platting. The Fausts will have an access easement to Vista Drive.

Brief Description of Variance: Variance requiring lots to have a minimum of 50' frontage at the street right-of-way
In deciding whether or not the applicant has presented sufficient proof to permit the granting of a variance, the Plan
Commission should consider the following:
The grant of a variance will not be injurious to the public health, safety, morals and general welfare
ofthe community.
The use and value of area adjacent to the property included in the proposed plat wi II not be affected
in a substantially adverse manner.
The need for the variance arises from some condition peculiar to the property and such condition
is not due to the general conditions of the neighborhood.
The strict application of terms of the ordinance to the property will constitute an unusual and
unnecessary hardship if applied to the property for which the variance is sought.
The grant of the variance does not interfere substantially with the Comprehensive Plan.

Ordinance which requires open space to be 75' in width.
2. State explanation of why variance is being requested:
This variance is requested in order to maintain desired lot depth west of Vista Drive.
3. State reasons supporting variance request:
To add to the existing 55' width of Common Areas Band C, a 20' landscape easement exists
in the rear of adjoining lots, where the existing fence/tree row will be retained. Open space
provided already exceeds open space required, and a 55' common area permits the retention
of more forested area.

This subdivision variance is requested from Section 6.2.1 of the Subdivision Control
Ordinance which provides that land within a floodway will not be subdivided.
2. State explanation of why variance is being requested:
This variance is requested because certain lots are within a flood plain.
3. State reasons supporting variance request:
The residence already exists and subdividing does not reduce its proximity to floodway.
The land is being platted in order to avoid the continuation of an unplatted lot.

Brief Description of Variance: Variance from reauirement that land within a floodwav not be subdivided
In deciding whether or not the applicant has presented sufficient proof to perm it the granting of a variance, the Plan
Commission should consider the following:
The grant of a variance will not be injurious to the public health, safety, morals and general welfare
ofthe community.
The use and value of area adjacent to the property included in the proposed plat wi II not be affected
in a substantially adverse manner.
The need for the variance arises from some condition peculiar to the property and such condition
is not due to the general conditions ofthe neighborhood.
The strict application of terms of the ordinance to the property will constitute an unusual and
unnecessary hardship if applied to the property for which the variance is sought.
The grant of the variance does not interfere substantially with the Comprehensive Plan.
Based on all the evidence presented by the petitioner, I approve of the requested subdivision
vanance.
