Hello Stacie,
Per the Rules of Procedure there is 15 minutes given during the public hearing for those opposed to the petition to
speak, you are correct. Typically, how that has been handled is that the time will be divided evening among all
those who wish to speak on the case. Yet ultimately it is up to the President of the BZA to make the decision on
how to allocate the time. Regarding additional time over 15 minutes, the Board if they so choose could as a whole
vote to suspend the Rules of Procedure to extend the amount of time for remonstration comments. Ultimately
though it is up to them, not staff, to make those decisions.

Bic,
I will start by saying that I have never been to a hearing, so I don’t know how
strict the time given is adhered to. Given the fact there are 3 variances being
discussed, I want to confirm the information that I was given(from outside
zoning officials) about the length of time given to the opposing side. Per
Carmel BZA rules, for one variance, the opposing side would get 15 minutes
but now with 3 variances being approved at the same time, my understanding
is that the time should be extended. Given these abnormal circumstances of
the hearing being after the fact and for 3 variances, will there be a time

extension if needed? I know that I am speaking and I do believe perhaps one or
two other people are also speaking for the opposition to the approval. I need
about 10-13 minutes to adequately cover my fact-based concerns about the
project and I am hopeful that the BZA will allow this.
My concerns about the hearing are:
I have been requesting variance hearings and showing Carmel the
ordinance infractions since September of 2022 with each issue that
arose on the yard. Perhaps if these variance hearings would have been
granted, we could have avoided the egregious overbuild and harm
caused to neighbors and the community.
The facts of the case don’t meet the code standards for variance
approval so the opposing parties should have reasonable time to show
this
With each piece of documentation has been added even as late as
Friday, there were more misleading and/or questionable statements
being added some of which will need to be addressed. One of which
was disappointingly from the city.
I do not believe that I am not asking for anything unreasonable, especially
as this item is the only one on the docket. I am hoping that this hearing
will be fair and equitable to all.
