Re: BZA Docket Nos. PZ-2024-00172, 178 V: Miclot Lot Cover & Setback Variances.
Dear Mr. Lazzara:
At the meeting held on Monday, October 28, 2024, the Carmel Board of Zoning Appeals Hearing Officer took the
following action regarding the Development Standards Variance (V) requests filed by you for the property located
at 426 Emerson Road:
APPROVED:
Miclot Lot Cover Variance - Development Standards Variance approval for:
• PZ-2024-00172 V: Maximum 35% lot cover allowed; 41% granted.
Miclot Setback Variance – Development Standards Variance approval for:
• PZ-2024-00178 V: Minimum 35-ft front yard setback allowed; 25-ft granted.
CONDITIONS:
• Payment into the Carmel Engineering Dept. Stormwater Fund if on-site stormwater detention is not
provided.
Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Development
Standards Variance approval is valid for three (3) years. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approval must
have been received and approval granted by this Department. The expiration date of the approval is Oct. 28, 2027.
Please include a copy of this letter with any permit application.
