Whereas, The Village of WestClay is legally incorporated in the State of Indiana and is empowered according to the laws governing the State of Indiana and Code of Bylaws adopted August 9. 1999; and Whereas, the Code of Bylaws have been dully amended on May 1, 2007, December 31, 2013, June 24, 2014, July 7, 2020, March 7, 2022, September 12, 2022, July 10, 2023, and September 11, 2023; and Whereas, the Board of Directors, as stated in Section 3.01 of the Code of Bylaws, has the authority to manage and control the business, property and affairs of the Village of WestClay Owners Association Inc.; and Whereas, the Board of Directors, as stated in Section 3.19 of the Code of Bylaws, has the obligation to faithfully observe and perform each duty imposed on the Corporation by the terms of the Master Declaration of Covenants, the Supplemental Declaration(s) of Covenants, and the Code of Bylaws; and Whereas, the Board of Directors have an obligation to preserve and enhance values, maintain a harmonious relationship among building structures, improvements, and the natural environment; and, Whereas, there is a proposal for a highly dense housing development adjacent to the Village on the Stout Farm; and Whereas, the proposed development will bring 135-142 lower priced, production-built homes immediately adjacent to the Village; and, Whereas, the proposed development may negatively impact property values; and, Whereas, the proposed development may adversely impact Carmel Clay Schools; and, Whereas, the proposed development may increase automobile traffic in the Village of WestClay; and, Whereas, the proposed development will require a new zoning classification due to the design of the project and the proposed density; and, Whereas, the Residents of the Village are concerned about the project and whether this development is appropriate; and, Whereas, the Residents expressed concern about individual lot size; and, Whereas, the Residents expressed concern the lot coverage was excessive with some homes utilizing 90% of the lot; and, Whereas, the Residents expressed concern about the lack of buffer and landscape with the Village and the proposed development: and, Whereas, the Residents expressed concern there are limited amenities and green space which is inconsistent with the Village and with other neighborhoods in west Carmel; and, Whereas, the potential development may create an unwelcome rental community consisting of investor owned properties and short-term rentals; and Therefore, Let It Be Resolved, the Board of Directors, acting on behalf of the residents of the Village of WestClay do hereby oppose this project; and, Be it Further Resolved, the Board of Directors shall use all authority granted in the governing documents and any legal means deemed appropriate to oppose this project; and, Be it Further Resolved, the Board of Directors shall communicate this opposition to the Carmel Plan Commission, the Carmel City Council, and the Mayor of Carmel.
