Main Street Rezone Letter James Shinaver November 1, 2024 Nelson & Frankenberger, LLC 550 Congressional Boulevard Suite 210 Carmel, IN 46032 RE: Zoning Change Confirmation Dear Mr. Shinaver, On or about March 21, 2016, the Carmel City Council adopted ordinance Z-611-16. This Ordinance approved a rezone of twelve parcels, including 311 and 331 West Main Street, Carmel, Indiana, from their previous zoning classification to the C-2/Old Town District zoning classification, as well as certain commitments for each parcel. At the time, the Statement of Commitments for 311 and 331 W. Main Street parcels (“Commitments”) were not executed by their respective owners. Pursuant to Indiana Code 36-7-4-1015, these commitments were a condition of the adoption of a rezoning proposal. As the commitments were not executed, the conditions were not fulfilled, and the 311 and 331 W. Main Street parcels were not rezoned. Subsequently, the owners of the 311 and 331 W. Main Street parcels executed and recorded Commitments on June 21, 2024. This letter therefore confirms that as of the date of the Commitments’ execution, 311 and 331 W.
