The applicant seeks the following development standards variance approval for a garage addition: 6. Docket No. PZ-2024-00207 V UDO Section 5.02(B)(3) The combined square footage of the Ground Floor of a Private Garage and/or Accessory Building shall not exceed 75% of the Ground Floor Area of the Principal Building; 87% requested. The 1-acre site is located at 9820 Deerfield Circle (Deerfield subdivision, Lot 10). It is zoned S1/Residence. Filed by Henry & Victoria Berman, owners. General Info: • The Petitioner seeks approval for a garage addition. • A variance is requested for accessory building ground floor area. . • The site is in Deerfield subdivision; HOA (Homeowner’s Association) approval was granted. • Surrounding this site are single family residential homes. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Garage Floor Area - • The Hamilton County Assessor's website shows the ground floor area of the residence at 1,242 square feet, and the existing attached garage at 576 square feet. It also shows a utility shed at 144 square feet. The remaining square footage allotment for accessory structures could not exceed 211.5 square feet to stay at the 75% maximum. • The proposed garage will be 26’ by 14’, or 364 sq. ft. in area. • The UDO requires that combined square footage of the Ground Floor of a Private Garage and/or Accessory Building shall not exceed 75% of the Ground Floor Area of the Principal Building; 87% requested. This is a variance of 12%. • The garage addition design, materials, and colors will match and/or complement the existing house. • A maximum 420 sq. ft. blacktop driveway addition is also proposed as part of this project. Remaining Review Comments: • All Planning/Zoning comments have been addressed. Final Comments: • The Planning Dept. supports the variance request, since the small addition will be a seamless expansion of the existing home & attached garage area. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of the variance request, and with adoption of the Findings of Facts submitted by the Petitioner.
