The applicant seeks the following variance approvals to construct a new accessory building (barn): 7. Docket No. PZ-2024-00212 V UDO Section 5.02(B)(3) Maximum 24’x30’ detached garage allowed; 52' x 30' requested. (And, the combined square footage of the ground floor area of garages and/or accessory buildings shall not exceed 75% of the ground floor area of the principal building, 97% requested.) 8. Docket No. PZ-2024-00213 V UDO Section 2.04 Maximum 18-ft accessory building height allowed; 27-ft requested. The 2.70-acre site is located at 1631 W. Main St. (not located in any subdivision). It is zoned S1/ Residence. Filed by Rob Cooper of Bespoke Construction on behalf of Andrew & Laurel Schneider. General Info: • The Petitioner seeks approval to construct a new accessory building (barn) around 360+ feet from the street. • They are looking to move/amend the existing accessory structure and rebuild it to a larger footprint. • Variances are requested for accessory building floor area and for height. • The site is not located in any subdivision; hence, no HOA (Homeowner’s Association) exists. • Surrounding this site are single family residential homes. • Please see the Petitioner’s info packet for more details on the variance requests. Variances Requested: Floor Area - • The UDO contains development standards for Accessory Buildings and Uses in section 5.02. • A maximum 24’x30’ detached garage is allowed (at 720 sq. ft.), and 52' x 30' is requested (at 1,560 sq. ft.). This is a difference of 840 sq. ft. • Also, the combined square footage of the ground floor areas of garages and/or accessory buildings shall not exceed 75% of the ground floor area of the principal building, and 97% is requested. This is a 22% change. • The barn will be set back 5 feet from the side and rear property lines (and 5-ft minimums are required). • The accessory structure will have concrete siding and a standing seam metal roof. • The exterior colors will be a black siding color and a charcoal color roof. Height - • The UDO’s definition of Building Height is: The vertical distance from the lot ground level to the highest point of the roof for a flat roof, to the deck line of a mansard roof and to the mean height between eaves and ridges for gable, hip and gambrel roofs. • The UDO allows a maximum 18-ft height for a detached accessory building, and 27-ft is requested (up to the roof peak). However, when measuring the height based off the UDO definition of Building Height, the proposed barn will be around 22 feet tall. This is a variance of 4 feet, or a 22% increase. Remaining Review Comments: • All Planning/Zoning comments have been addressed. Final Comments: • The Planning Dept. supports the two variance requests for this 2.5-acre property. • It will be hard to see the barn from the street. Also, landscaping is proposed. • The adjacent neighbors’ houses are set back a fair distance from the barn, ranging from 168 feet to 286 feet. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: The Dept. of Community Services (DOCS) recommends positive consideration of the variance requests, and with adoption of the Findings of Facts submitted by the Petitioner.
