In the note I sent you last week I likened this zoning exception request to dropping a single unit motel into a residential community and I said it was a terrible idea both for Lexington Farms and, more generally, for any residential community in Carmel. But, a little additional thought would show that granting this request is an even worse precedent than I indicated above. It is, in fact, the equivalent to dropping an unstaffed, single unit motel into this residential community. Actual motel/hotels are staffed 24/7 with on-site personnel who are available to take care of any guest needs or to ensure that guests do not create disturbances. In the instance of this zoning request, the owner of this "motel" will live out of town and the responsibility for any disturbances created by the guests will fall on the neighbors who would be immediately affected by any disruptive behavior. That is unfair. It doesn't matter if the property owner promises to use cameras or other remote monitoring technology because the owner will not monitor that remote technology 24/7 while the guests are in residence, despite good intentions. So, the onus for living with or reporting disturbances will remain with the neighbors despite any good intentions of the property owner. This is just a really bad idea for Lexington Farms or for any other residential community in Carmel and I urge that this appeal be denied.
