The applicant seeks the following development standards variance approvals:
Docket No. 07030018 V Section 25.07.02-10.b signs oriented south

The site is located at 12065 Old Meridian St. and is zoned B-6/Business within the US 31 Overlay.

General Info:
The petitioner seeks variance approval for 4
tenant wall signs total; only one sign is
allowed per road frontage for a multi-tenant
multi-level building. It is possible, since this
site has two road frontages, to move an
allowable sign to another road frontage, so
that two signs are facing one frontage.
However, when two signs are both facing the
same frontage, one sign must be a wall sign
and the other must be a ground sign; this is
not the case for this site. However, two wall
signs are oriented south, not facing a road
frontage, which is not permitted by the Sign
Ordinance.
Analysis:
The parcel is located at the intersection of two
roads that do not meet at a 90-degree angle.
This has caused the subject parcel to be triangular in shape. The building placement took much thought
and creativity. The signage is

1.) The approval of this variance will not be injurious to the public health, safety, morals, and
general welfare of the community because: due to the angle in which the streets intersect and the
way the building is placed on the site, the signs will still be legible from the adjacent streets, and
possibly from US 31.
2.) The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because: due to the angle in which the streets
intersect and the way the building is placed on the site, the signs will still be legible from the
adjacent streets, and possibly from US 31.
3.) The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because: the signs will have to face the road
frontages, which intersect at a peculiar angle. The sign locations may be hard to read from the road
due to the angle of the roads.

1.) The approval of this variance will not be injurious to the public health, safety, morals, and
general welfare of the community because: due to the angle in which the streets intersect, and
the accessibility of the site, each tenant must be identified by a wall sign so that patrons of the site
can easily identify the tenant's location and safely navigate to the site.
2.) The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because: due to the angle in which the streets
intersect, and the accessibility of the site, each tenant must be identified by a wall sign so that
patrons of the site can easily identify the tenant's location and safely navigate to the site.
3.) The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because: only one wall sign per road frontage (2
total signs) will be allowed for this multi-tenant multi-level building, possibly causing difficulty in
site identification for patrons of this site.
Findings of Fact: sign types
1.) The approval of this variance will not be injurious to the public health, safety, morals, and
general welfare of the community because: having all wall signs will appear cohesive in
design/placement to give this particular site a polished look. Mixing roof, ground, and wall signs
may take away from that.
2.) The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because: The wall signs will appear cohesive in
design/placement to give this particular site a polished look. Mixing roof, ground, and wall signs
may take away from that.
3.) The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because: The site would need a mix of ground,
wall, and roof signs, which may affect the overall character ofthe site at this unique location.
Recommendation:
The Dept. of Community Services recommends positive consideration of Docket Nos. 07030018-20 V
after all questions/concerns are addressed.
