On this one we let them encroach the same amount the current accessory structure is encroaching. After talking
with them, it seemed reasonable for us to be supportive up to this limit.

Hi, Jarrod –
I want to run this by you one more time. It still looks like they are asking for a 4-ft setback from the rear property
line (and the addition is also mostly in the easement). I thought you had requested that they did not encroach so
much into the easement, for your department to be supportive of the BZA variance request (and the CTE). Please
let me know your thoughts on this before Wednesday, when the BZA Dept. Report is released. Thank you!

Last month, your variance items were transferred to the Feb. 24 Regular meeting of the BZA (which has 5
members). If you can get your public notice legal ad to The Current in Carmel newspaper by noon
tomorrow/Friday, we still might be able to get your item on the Feb. 24 regular BZA meeting agenda. Again, here is
their contact info: 317-489-4444 or legals@youarecurrent.com, and the Notice of Public Hearing template is in the
attached Word document. (Your legal ad will be published a little late, but, at the meeting, we can request that the
BZA suspend their Rules of Procedure and hear your item that same night.)
Below are the dates and deadlines for the Feb. 24 Regular BZA meeting, and attached is the Variance
Handout/Application for the regular BZA meeting (slightly different forms and timelines for the regular mtg. vs. the
hearing officer meeting).
Please also email Joe and me your revised site plan and floor plan/building design.

Again, please note that Planning Staff will not be supportive of the BZA variance requests if the Carmel Engineering
Dept. is not supportive of the encroachment into the easement. And, with variances, you have to prove a practical
difficulty as to why you cannot comply with the zoning ordinance regulations.

Yes, I would like to see if we can make the Feb meeting, after communicating with Jarrod, we are able to
move forward with the request for encroachment and variance. No change to the original dimension, we
will keep the encroachment the same as the current detached structure.

Good afternoon,
Reducing the encroachment would help with approval. If you were to leave 7.5+ feet of easement from the edge
of exterior wall then we would be able to review for possible approval of a building addition.
If you look at a detached structure, it may be treated as an accessory structure which may be able to encroach
slightly more.

Hi Jarrod & Angelina,
Based on Jarrod's response a couple weeks ago, I have a couple questions. Would it make a difference if
we decrease the width by 2 feet to have less of an encroachment, and use a separate mini-split HVAC
seperate electrical Sub-Panel? Lastly, would having a detached structure make a difference? I am just
trying to see if there are any options for the homeowner?

The deadline for the Nov. 25 BZA hearing office was last Monday, Oct. 28. We do not have a BZA Hearing Officer
scheduled for December. If a special hearing becomes available in December, I can let you know.
Our next scheduled BZA HO meeting is on Monday, January 27. The filing deadline is on Monday, December 30.
I was unable to pull up the Building Permit info for B-2024-01475. What’s the variance for? Is there any possible
you can amend your plans to avoid the variance?

Hi Jeremey – I just sent you a separate email regarding the rear easement and consent to encroach request.
And, with further research, you probably will need two BZA variances – one for rear yard building setback, and
one for lot coverage exceeding 35%.
Now, we just need to wait for feedback from the Carmel Engineering Dept. about the CTE…

I have a customer that signed with us to build a sunroom addition, and I am waiting on the HOA approval
package that is coming before Jan 1st. Knowing we need to get an application started 30 days before the
meeting, I went ahead and submitted an application. I know Joe is out of the office until the beginning of
