HomeMy WebLinkAboutFindings of Fact_DRAFTPage 1 of 2 Exhibit “E” DRAFT FINDINGS OF FACT CARMEL ADVISORY BOARD OF ZONING APPEALS HEARING OFFICER CARMEL, INDIANA Docket No.: __________________ Petitioner: Story Custom Development, LLC and Story Cottage Request: UDO, Article 9.08 (A)(2), Group Homes for twelve (12) or fewer residents: Seeking Special Exception Approval for a Senior Group Home. FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE 1. The approval of this Special Exception Request will not negatively affect surrounding property values: The approval of the requested Special Exception for a Senior Group home will not negatively affect surrounding property values because the proposed home is a custom designed home to be constructed by RJL Custom Homes (Bob Lunsford), who has well over 30 years’ experience in designing and building custom homes. Included with the filing are proposed home elevations and perspectives which illustrate the design character and quality of the home. Further, other than the Special Exception request for permission to operate the Senior Group Home on the subject site, no other variances to the underlying R-1 Residential development standards are begin sought, as the site plan complies with all underlying R-1 Residential development standards. 2. This Special Exception will be compatible with existing land uses in the neighborhood because: Surrounding the subject Real Estate are existing homes (to the north and south) and directly to the east is an existing home and portions of the Woodland Golf Course. The proposed home is of a custom design to be constructed by RJL Custom Homes (Bob Lunsford), who has well over 30 years’ experience in designing and building custom homes. Included with the filing are proposed home elevations and perspectives which illustrate the design character and quality of the home. Additionally, the site plan includes preserving existing trees along portions of the northern and eastern perimeter of the subject site, as well as new landscape plantings around the proposed home and all exterior lighting requirements for the R-1 Residential zoning classification shall be adhered to. Further, other than the Special Exception request for permission to operate the Senior Group Home on the subject site, no other variances to the underlying R-1 Residential development standards are begin sought, as the site plan complies with all underlying R-1 Residential development standards. As a result of the foregoing, the proposed home will be compatible and consistent with the other residential homes surrounding the site. Page 2 of 2 3. Vehicle and pedestrian traffic, in and around the premises will not be substantially affected by this Special Exception because: There is an existing driveway cut onto Westfield Boulevard which will be maintained, thus no new points of access and no new driveway cuts onto Westfield Boulevard are proposed. The site plan accommodates adequate parking for residents and guests and the Applicant will make the required monetary contribution into the City’s Thoroughfare Plan as required for construction on the Real Estate. Construction of a multi-use path along Westfield Boulevard will take place at the time the City advances such a project for this segment of Westfield Boulevard. DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals Hearing Officer that Development Standards Variance Docket No. _______________ is granted, subject to any conditions stated in the minutes of this meeting, which are incorporated herein by reference and made a part hereof.
