Please respond in writing to the preliminary review comments listed at the
bottom of the 12/16 docket no. assignment email, and please do that before
noon on Friday, Jan. 17. For your convenience, they are listed again, below: a)
Please make checks payable to City of Carmel if you are paying via check. b)
Provide a copy of the Official List of Adjacent Property Owners from the
Hamilton County Auditors Office. (Make sure to check Carmel BZA on their
form.) c) *The Current in Carmel only prints on Tuesdays, and their filing
deadline is usually 14 days prior to their printing date. Please submit your
Microsoft Word file of the legal ad to them before Noon, Fri., Dec. 27 so that
it prints on time. Their contact info is 317-489-4444 or
legals@youarecurrent.com. (Please refer to the Handout for a template of
wording to use for the legal ad and the mailings the Notice of Public
Hearing.) d) The mailings/notices to the adjacent property owners should be
done by first class mail with Certificate of Mailing (not Certified Mail). (Please
provide us with the stamped receipts of the certificate of mailings for the file
on or before Noon, Wed., January 22.) e) Please provide the filled out &
notarized Placement of Public Notice Sign Placement Affidavit form (found in
Handout) once the sign is placed. f) Please provide the filled out & notarized
Petitioners Affidavit of Notice of Public Hearing form (found in Handout). g)
Please provide the filled out Notice of the Public Hearing form/template
(found in Handout). (DONE.) h) Please provide proof of notice, such as
Publishers Affidavit from the newspaper, once you receive them. i) Please
make sure to list out the true practical difficulties and hardships associated
with having to comply with the zoning ordinance. j) Please have your
Findings of Fact written out for each separate variance (four (4) total), and
please write them so that they address the specific topic of the variances
requested, with more details as to why you need that specific variance
approved, etc. (DONE.) k) Please provide a conceptual landscape plan, and
please make sure that at least one medium or large native shade tree from
the Recommended Species List is shown for the front yard:

Carmel Engineering Dept. and will also pay into the stormwater fund / fee if
you cannot provide on-site stormwater detention (You may contact John

software.

Items a-j & l have been addressed. Regarding Item k,
the Owner/Petitioners has an approved budget of
$40,000 for landscaping to be designed by a
professional landscape architect. Petitioner and the
architect will confirm that the appropriate guidelines
concerning the native shae trees are met.

Per UDO section 3.64.C, Driveways leading to the garage shall not be wider
than 12-ft, except within 30 feet of the front of the garage, where the
driveway may be up to 18-ft wide if oriented forward a Front Yard, OR be the
width of the garage if located behind the principal Building or accessed by
and alley.

Comment
Please show/label the window well on the site plan, and label its distance
from the side property line. A window well and only encroach at most 2 feet
into the required side/rear yard for the specific zoning district (which is 5-ft
for this zoning district).

Comment
What is the fireplace setback from the side property line? Please confirm that
the fireplace will not encroach more than 2 feet info the 5-ft side yard
setback for this Old Town Overlay zoning district.

In order for the Engineering Department to support the variance to exceed
the allowable lot coverage, stormwater detention measures must be
engineered and installed in accordance with the City's Stormwater Technical
Standards manual, or a $6,000 contribution to the City's thoroughfare plan
can be made. Please indicate how the project would like to proceed in
response to this comment. Please note, if the project opts to install detention
measures, they will need to be reviewed and approved prior to the
engineering department supporting the variance to exceed allowable lot
coverage. This comment will remain unresolved until those standards have
been met or a commitment to contribute the $6,000 has been indicated in
the applicant's response.

With revisions to the site plan, lot coverage is still over
the standard at 52.1%. We commit to a $6000
contribution to the City's Thoroughfare fund.

The BZA Hearing Officer approved the variances with 2 conditions: 1.) paying
into the stormwater fund or providing on-site stormwater detention, and 2.)
providing a landscape plan with the residential building permit that includes
at least one medium or large native shade tree from the Recommended Tree
Species List in the front yard.
