3. Docket No. 06010005 Z: Shelborne Property PUD
The applicant seeks to rezone 20 acres from S l/Residential to PUD/Planned Unit
Development for the purpose of developing single-family residences.
The site is located on the west side of Shelbome Road, north of 1218t Street.
Filed by Charles Frankenberger of Nelson and Frankenberger for Indiana Land
Development Co.
The applicant is requesting approval of a Planned Unit Development to allow the construction of
40 single family detached homes. The primary access to the site is a boulevard entrance from
Shelbome Road. Two stubs to the north and south are proposed. The parcel to the north is
currently undeveloped and the stub to the south will connect to the Kendall Wood Subdivision.
Please see the revised packet prepared by the applicant for an overview of this rezone.
The public hearing for this item was held at the February 21, 2006 Plan Commission meeting.
Two people spoke in opposition in regards to the density of the project. The petition has been
discussed at three meetings of the Subdivision Committee. Through those discussions, the
petitioner has revised the architectural requirements and some of the open spaces. Changes made
since the March 4th meeting can be found behind Tab 1 (items 14 - 17 only).
Engineering issues have been resolved.
Landscape plan issues are as follows
1. There is landscaping conflicts along the west side (a 25' drainage and utility easement
with a 15' tree preservation easement over the top), and over other various utility lines,
sewers, and drainage ways. Plus, on the north perimeter there does not appear to be a
landscape buffer or tree preservation easement at all.
2. Determine at this time if the bufferyard tree preservation can be accomplished or not.
Show the bufferyard vegetation in photographs and tell us how you will preserve it, or tell
us that tree preservation is not possible, and show us a plan of perimeter bufferyard
plantings that meets the ordinance. One can not have a tree conservation buffer with a
drainage swale graded through the middle of it, and a 12"-15" sewer pipe installed in it.
3. Determine if the Hamilton County or Carmel Departments will allow the planting of
street trees at this point
The petitioner seeks a recommendation with the following commitments:
1. The above landscape plan issues will be fully resolved and a compliant revised plan
will be submitted for packets one week prior to the Plan Commission Hearing.

2. Petitioner is responsible for required upgrades to Shelbome Rd along the project
frontage. These upgrades can be constructed or funded (for future construction). The
petitioner is' required to coordinate with City Engineering to determine these
improvements (or cost thereof), and commit to construction or funding prior to
approval. This commitment must be recorded.
Staff feels that unless there are other issues that the petitioner wishes to revisit, the
Subdivision Committee should make a recommendation on this project and move it
forward with a recommendation. .
