The applicant seeks the following variance approval for a 7’x13’ front porch addition: 6. Docket No. PZ-2024-00231 V UDO Section 2.08 Minimum 35-ft minimum front yard setback required; 24-ft requested. (There is also a 30-ft platted front yard setback for Cool Creek North Subdivision.) The 0.33-acre site is located at 1531 White Ash Drive (Cool Creek North, Lot 75). It is zoned R1/Residence. Filed by Jeremy Snyder of Artisan Outdoor Craftsman, on behalf of Mike Shultz, owner. General Info: • The Petitioner seeks approval to add a front porch. • A Building Permit was applied for, permit B-2024-01534. • Variance is requested for front setback. • The site is in Cool Creek North subdivision; an HOA (Homeowner’s Association) does not exist. • Surrounding this site are single family residential dwellings. • Please see the Petitioner’s info packet for more details on the variance request. Variance Requested: Front Setback - • The UDO allows a minimum 35-ft front yard building setback in the R1 zoning district, and 24-ft is requested. This is a variance of 11 feet or a 31% change. • The addition will be minimal in size –7 feet by 13 feet (or 91 square feet in area). • There is also a platted 30-ft front yard building setback, that is part of the Cool Creek North subdivision plat. A Replat application has been filed to reduce or remove the platted front setback line. It is Docket No. PZ- 2025-00007 SP Replat. • The front porch addition will look like the following: cedar is to be used to cover all treated framing and will be painted to match the existing house trim. The proposed shingles will also be the same color as existing shingles. Remaining Review Comments: • All Planning/Zoning comments have been addressed. Final Comments: • The Planning Dept. supports the variance request, as long a Replat Application is submitted and reviewed/approved. • The lot (and subdivision) has a platted 30-ft building line in the front yard, so that needs to be reduced or removed, as well, and that can be done with the Replat Application. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of the variance request, with the condition of Replat Application approval, and with adoption of the Findings of Facts submitted by the Petitioner.
