The applicant seeks the following development standards variance approval for a fence: 7. Docket No. PZ-2024-00232 V UDO Section 5.09(B) Maximum 42-inch fence allowed in front yard with at least 25% visibility; 48-in (4-ft) aluminum fence requested. The 0.49-acre site is located at 12443 Pebblepointe Pass (Bayhill subdivision, Lot 17). It is zoned S2/Residence. Filed by Wendy Thiel, owner. General Info: • The site is a Corner Lot, with two street frontages and two front yards. • The Petitioner seeks approval for a taller than allowed fence that partially encroaches into the front yard. • A Fence Permit was applied for, permit F-2024-00054. • The site is in Bayhill subdivision; HOA (Homeowner’s Association) approval has been granted. • Surrounding this site are single family residential dwellings. • Please see the Petitioner’s info packet for more details on the variance request. Variance Requested: Fence Height - • The UDO allows a maximum 42-inch tall fence in the front yard (with at least 25% visibility); and a 48-inch (4-ft) tall decorative black aluminum metal fence is requested. This is variance of 6 inches, or a 14% change. • Fence will be located in mostly the side and rear yard, but also some of it will be located in the front yard. • The fence will be a black ornamental metal fence design. Remaining Review Comments: • All Planning/Zoning comments have been addressed. Final Comments: • The Planning Dept. supports the variance request. Only a small portion of this 6-inch taller than allowed fence will encroach into the front yard of this Corner Lot. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of the variance request, and with the adoption of the Findings of Facts submitted by the Petitioner.
