CARMEL BOARD OF ZONING APPEALS HEARING OFFICER
DEPARTMENT REPORT
MONDAY, JANUARY 27, 2025
(V) White Residence Addition Rear Setback Variance.
The applicant seeks the following variance approval for a rear building addition and deck:
12. Docket No. PZ-2024-00246 V UDO Section 2.08 Minimum 20-ft rear yard setback
required; 16.5-ft requested.
(There is also an easement in the back yard.) The 0.25-acre site is located at 13695 Autumn Lake Ovlk.
(Autumn Lake Subdivision, Lot 11). It is zoned R1/Residence. Filed by Kevin Schluchter of Cutting
Edge Hardscapes, on behalf of Adam & Shelly White, owners.
General Info:
• The Petitioner seeks approval to build a deck and 3 seasons room addition to the rear of the house.
• A Building Permit was applied for, permit B-2024-01538.
• Variance is requested for rear building setback.
• The site is in Autumn Lake subdivision; and HOA (Homeowner’s Association) approval occurred.
• The lot has frontage on a detention pond/lake.
• Surrounding this site are single family residential uses.
• Please see the Petitioner’s info packet for more details on the variance request.
Variance Requested:
Rear Setback -
• The UDO allows a minimum 20-ft rear yard setback, and 16.5-ft is requested. This is a variance of 3.5 feet.
• There is around 35-ft of distance from the rear of the house to the water line of the pond.
• The rear of the lot has a drainage and lake maintenance easement, plus another drainage easement.
• Since the improvements will also encroach into an easement, Consent to Encroach (CTE) approval is
required from the Carmel Engineering Department and the Board of Public Works and Safety (BPW). (CTE
application CO-2024-0051 was approved at the BPW’s Jan. 22 meeting.)
• The deck and building addition’s colors and materials will complement the existing house.
• The existing trees along the shore/water line will remain. No removal is required.
Remaining Review Comments:
• All Planning/Zoning comments have been addressed.
Final Comments:
• The Planning Dept. supports the variance request, since the Consent to Encroach was approved by the BPW.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of the variance request, and
with adoption of the Findings of Facts submitted by the Petitioner.
