The applicant seeks the following development standards variance approval: 1. Docket No. PZ-2024-00187 V UDO Sections 3.92(C) and 5.03(B) Maximum 0.3 footcandles allowed along the property lines; 0.6 to 3.7 footcandles along north and west property lines requested. The site is located at 10800 N. Michigan Rd. (not in any subdivision) and is zoned B3/Business and US 421– Michigan Rd. Overlay. Filed by Lauren Farrow of PE Consulting Corp, on behalf of Security Federal Savings Bank, owners. General Info: • The Petitioner seeks approval for a lighting plan for a bank with drive thru that will spill light past the property lines, at greater than allowed levels. • A variance is requested to exceed the allowed footcandle lighting levels at the property lines. • The site is not located in any subdivision. • Surrounding this site are office and commercial uses. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Footcandle Lighting Levels - • The UDO allows for a maximum 0.3 footcandles along the property lines; and 0.6 to 3.7 footcandles along north and west property lines are requested. • The placement of the lights and light fixtures are causing the need for the variance request. • The need for the variance is caused by the Petitioner. They can amend their lighting plan proposal to comply with the Unified Development Ordinance development standards. There is no practical difficulty or hardship. Final Comments: • Planning Staff would like to reiterate that the need for the variance is being caused by the Petitioner. Their photometric plan can be amended to comply with the UDO. There is no practical difficulty or hardship. Findings of Fact: • The BZA attorney should be directed to write up the negative Findings of Fact. Recommendation: • The Dept. of Community Services (DOCS) recommends negative consideration of the variance request, and with adoption of the Findings of Facts to be written up by the BZA attorney.
