Please respond in writing to the preliminary review comments listed at the
bottom of the 01/24 docket no. assignment email, and please do that before
noon on Friday, Feb. 14. For your convenience, they are listed again, below:
a) Please make checks payable to City of Carmel if you are paying via check.
b) Provide a copy of the Official List of Adjacent Property Owners from the
Hamilton County Auditors Office. (Make sure to check Carmel BZA on their
form.) c) *The Current in Carmel only prints on Tuesdays, and their filing
deadline is usually 14 days prior to their printing date. Please submit your
Microsoft Word file of the legal ad to them before Noon, Fri., Jan. 31 so that
it prints on time. Their contact info is 317-489-4444 or
legals@youarecurrent.com. (Please refer to the Handout for a template of
wording to use for the legal ad and the mailings the Notice of Public
Hearing.) d) The mailings/notices to the adjacent property owners should be
done by first class mail with Certificate of Mailing (not Certified Mail). (Please
provide us with the stamped receipts of the certificate of mailings for the file
on or before Noon, Wed., Feb. 19) e) Please provide the filled out &
notarized Placement of Public Notice Sign Placement Affidavit form (found in
Handout) once the sign is placed. f) Please provide the filled out & notarized
Petitioners Affidavit of Notice of Public Hearing form (found in Handout). g)
Please provide the filled out Notice of the Public Hearing form/template
(found in Handout). h) Please provide proof of notice, such as Publishers
Affidavit from the newspaper, once you receive them. i) Please make sure to
list out the true practical difficulties and hardships associated with having to
comply with the zoning ordinance. j) Please have your Findings of Fact
written out for each separate variance (two (2) total), and please write them
so that they address the specific topic of the variances requested, with more
details as to why you need that specific variance approved, etc. k) Additional
review comments (if any) will be issued through ProjectDox, our online plan
review software.

Please provide a copy of the Carmel Engineering Dept. approval for the
proposed pervious pavers drainage system.

In this ProjectDox case, it shows that the Carmel
Engineering Dept. and CrossRoads Engineers approved
the variance request, too.

I believe that the building permit was issued; however, it was noted in that permit that BZA variance approval would
need to be gained before a final inspec?on would be performed and a cer?ficate of occupancy could be issued.
That being said, two variance items will be heard at the Monday, February 24 Board of Zoning Appeals mee?ng. The
Pe??oner will have to prove a prac?cal difficulty as to why they cannot comply with the zoning ordinance regula?ons.
The agenda item is listed below, as well as a direct weblink to the variance case file. The Pe??oner has also been working
with the Carmel Engineering Dept. to design an approvable pervious pavers drainage plan.

The applicant seeks the following development standards variance approvals for a pool & pa?o area:
Docket No. PZ-2025-00005 V Silvara PUD Sec?on 5.2 and UDO Sec?on 5.02(C)(7) Sideyard Setback - a
swimming pool, hot tub, or its deck or equipment shall be set back 10-? from the side lot line and rear lot line; 9-?
requested.
Docket No. PZ-2025-00006 V Silvara PUD Sec?on 6.1 Maximum 35% lot
cover allowed; 55% requested.
The 0.28-acre site is located at 12167 Frenzel Pkwy (Jackson’s Grant on Williams Creek Subdivision, Lot 198). It is zoned
Silvara PUD/Planned Unit Development Ordinance Z-652-20. Filed by Lauire Tinsley of Williams Custom Art Builders, on
behalf of Ira & Leslie Maher, owners.

I am the chair of the Architectural Review Commi?ee (ARC) in Jackson’s Grant subdivision. Last year we reviewed a
swimming pool request for the Maher family, 12167 Frenzel Parkway. The commi?ee granted a condi?onal approval with
the s?pula?on that a lot coverage variance be obtained first from the BZA. It has not.

Construc?on has started; the construc?on supervisor obtained a building permit, B-2024-01440, on 11/25/24. He says
that this implies the city has no problem with the lot coverage, and he does not need to get a variance from BZA as that
would be redundant.
Is that true? Does the issuance of a Building Permit eliminate the need for a BZA variance that our commi?ee has asked
for? Your help in this ma?er will assist us in keeping our records accurate.
