Docket No. 06120004 Z: Armstrong Rezone The applicant seeks to create to rezone property from SI to B3. The site is located at the NE comer ofW. 98th Street and Michigan Road (US 421) and is zoned S 1 within the US 421 Overlay. Filed by Paul Reis of Bose McKinney, & Evans LLP for Armstrong Family Charitable Trust and Guaranty Properties Ltd. The applicant seeks to rezone 2.7 acres from SI to B3 for the purposes of establishing retail and office uses. This property is within the US 421 Overlay Zone. See the information packet for full details. These properties, along with the entirety of the North Augusta Subdivision are located within the US 421 Overlay Zone. Both the Comprehensive Plan and the Zoning Ordinance support a rezone from residential use to commercial use for areas within the US 421 Overlay. The applicant's proposed concept connects to the access street stub to the north and mimics the style and function of the West Carmel Marketplace outlots. This petition is for the rezone only, and a subsequent DP and ADLS would return to the Plan Commission for public hearing and review if these parcels are successfully rezoned. The US 421 Overlay requires a minimum of 23 acres for new Development Plans to be considered. The applicant will need to acquire more acreage or seek a variance prior to Development Plan submittal.
