1571 Asherwood Lane - Development Standards Variance Project Description
The applicants, Hon Vien and Trina Sherlitz Vien, (collectively, the “Viens”), own a parcel of
real estate identified by the Hamilton County, Indiana Auditor’s Office as Tax Parcel Identification
Number 17-13-09-00-13-033.000, which parcel has a common address of 1571 Asherwood Lane,
Carmel, IN 46032 and is also identified as Lot 33 in the Asherwood subdivision (collectively, the
“Real Estate”). The Real Estate is zoned S1/Residence and behind Tab 2 is a site location map.
The Viens home is being built by Old Town Design Group and the Viens desire to construct an
outdoor grilling station and seating area which will include a covered roof to provide protection from
the weather and elements to the furniture, grilling and kitchen station, outdoor TV and electrical
equipment and other household items to be located within the outdoor grilling/seating area. Behind
Tab 3 is the Site Plan and behind Tab 4 are exhibits regarding the grilling station.
In order to construct the roof element over their outdoor grilling/outdoor seating area, the Viens
are seeking a development standards variance from UDO Section 5.02 (B) (3) (a) – Maximum
Accessory Square Footage; 79% permitted via Docket Number PZ-2023-00172V; requesting 87%.
Absent approval of the requested variance, strict application of the terms of the Zoning
Ordinance will result in practical difficulties to the Viens in that will be prevented from constructing an
appropriate outdoor seating area and grilling station, with a roof element to provide protection from the
elements to the furniture, grilling and kitchen station, outdoor TV and electrical equipment and other
household items to be located within the outdoor grilling/seating area. Behind Tab 5 are the Findings
of Fact for the variance request.

2025, meeting.

FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because:
The requested variance is necessary in order to construct an outdoor grilling station and seating area,
with a roof element and approval of the variance will not be injurious to the public health, safety, morals
and general welfare of the community.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
Associated with the request to construct the outdoor grilling station and seating area, the Viens are also
building a custom home with Old Town Design Group and the new custom home and outdoor grilling
station and seating area should not have an adverse impact on the area adjacent to the property included
in the variance and should instead have a positive impact on the use and value of the homes and area
surrounding the Real Estate.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property because:
Absent approval of the requested variance, strict application of the terms of the Zoning Ordinance will
result in practical difficulties to the Viens in that will be prevented from constructing an appropriate
outdoor seating area and grilling station, with a roof element to provide protection from the weather and
elements to the furniture, grilling and kitchen station, outdoor TV and electrical equipment and other
household items to be located within the outdoor grilling/seating area.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals Hearing Officer that Development
Standards Variance Docket No. PZ-2025-0021 V is granted, subject to any conditions stated in the minutes of
this meeting, which are incorporated herein by reference and made a part hereof.
