(V) Vien Residence, Additional Variance.
The applicant seeks the following development standards variance approval for an outdoor grilling
station and seating area with a covered roof:
11. Docket No. PZ-2025-00021 V UDO Section 5.02(B)(3)(a) The combined square
footage of the Ground Floor Area of a Private Garage and/or Accessory Building shall not exceed
75% of the Ground Floor Area of the Principal Building, Previously approved 79% from Docket
No. PZ-2023-00172 V; 87% requested.
The 1.33-acre site is located at 1571 Asherwood Ln. (Asherwood Subdivision Lot 33) and is zoned
S1/Residence. Filed by Jim Shinaver and Jon Dobosiewicz of Nelson & Frankenberger, LLC., on behalf
of Hon Vien and Trina Sherlitz-Vien, owners.
General Info:
• The Petitioner seeks approval to add a new covered outdoor grilling station to the site.
• Building Permit B-2024-01442 was applied for.
• Variance is requested for ground floor area of the accessory building.
• Prior variances granted were for the pool house height and pool house ground floor area.
• The site is in Asherwood subdivision; HOA (Homeowner’s Association) approval has been granted.
• The accessory building will not encroach into any drainage or utility easements.
• Surrounding this site are single family residential dwellings.

Variance Requested:
Ground Floor Area -
• The UDO states that the combined square footage of the Ground Floor Area of a Private Garage and/or
Accessory Buildings shall not exceed 75% of the Ground Floor Area of the Principal Building; and 87% is
requested. This is a variance of 12%.
• The new structure will complement the colors and exterior building materials of the existing house. It is open
air on the sides, with just a roof.
Remaining Review Comments:
• All Planning/Zoning comments have been addressed.
Final Comments:
• The Planning Dept. supports the variance request; the grill station will be located 3-ft away from the side
easement, and will be integrated with the swimming pool patio area.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of the variance request, and
with the adoption of the Findings of Facts submitted by the Petitioner.
