Re: BZA Docket Nos. PZ-2025-00005 to -00006 V: Maher Pool Variances
Dear Ms. Tinsley:
At the meeting held on Monday, February 24, 2025, the Carmel Board of Zoning Appeals Hearing Officer took the
following action regarding the Development Standards Variance (V) requests filed by you for the property located
at 12167 Frenzel Parkway:
APPROVED: Maher Pool Variances – Development Standards Variance approvals for:
• PZ-2025-00005 V: Side Yard Setback – a swimming pool, hot tub, or its deck or equipment shall be
setback 10-ft from the side lot line and rear lot line; 9-ft granted.
• PZ-2025-00006 V: Maximum 35% lot coverage allowed; 55% granted.
CONDITIONS:
• Final Carmel Engineering Dept. review and approval in ProjectDox.
Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Development
Standards Variance approval is valid for three (3) years. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approval must
have been received and approval granted by this Department. The expiration date of the approval is Feb. 24, 2028.
Please include a copy of this letter with any permit application.
