Hi Angie thanks for the heads up. It looks like most of the proposed structures on the North part of the drain are out of
the easement so we wouldn’t have any say with that and the only thing that is proposed that could potentially encroach
into that easement are the boulders. I would highly recommend removing the boulders entirely because if they were to
apply for an encroachment at this point, they would need to include all the existing trees which we definitely would not
permit. In other words, their property is technically in violation of our standards as of now and formally asking us for
even more encroachments would force us to address the already existing violations so the smartest move would be to
stay out of the easements entirely with their proposed work.

supportive of any encroachment into the RDE? (The site plan shows proposed landscaping, and a small corner of
the pool and wall encroaching into the easement area.) Also, does the petitioner need to seek approval from your
dept. and the county drainage board, too? Please let us know. Thank you.

Thank you for this information. To be clear, there are NO boulders planned to be installed as part of this
project. There was some confusion due to a notation on the plot plan about pre-existing boulders. There
are three pre-existing stones or "boulders" between the existing patio footprint and the drain that were
installed either as decoration or retainage at the time the house was built in 2017. Photo attached. We
can remove those as part of this project but they have caused no problems in 8 years.
I find the comments about the other plantings in the drainage easement puzzling as those were all
installed by the original developers of Jackson's Grant (Republic Development) and not by the
homeowners in that area (there are four houses along this drainage easement that all have these
buffering plantings). Note that the Carmel Urban Forester approved all of this in 2015 as reflected in the
attached which was two years before our house was even completed. There seems to be some
disconnect in this regard.
In any event, the ultimate conclusion that we will not be building in the drainage easement is correct. We
have planned the layout while being cognizant of the drainage easement and drain.

After review and response from HamCo surveyor's, it looks like the improvements are outside of the easements.
The Consent to Encroach will not be needed and the Right of Way permit is proceeding.
