We are doing so to honor a verbal agreement. The granting of an easement should not be construed or interpreted in any fashion as an endorsement for construction of a pole barn. As we have discussed the granting of the easement will need to be agreed upon by the Waterstone Homeowners Association and the homeowners it represents. All of the aforementioned is conditioned on the Windpointe deed restrictions and covenants that are yet to be finalized and attached as conditions of the easement. We believe you have a separate agreement with the HOA pending your review. In addition, as of the writing of this letter we have not received any formal legal review as to assumption of liability on the easement property. Any final agreement between us is dependent on a satisfactory negotiation as to insurance, damage, personal and property liability.
