Dear Joey,
As previously discussed we are willing to grant an easement on our property for the
purpose of allowing you access to Windrift Way and to assist in your development of a
home. We are doing so to honor a verbal agreement. The granting of an easement should
not be construed or interpreted in any fashion as an endorsement for construction of a
pole barn.
As we have discussed the granting of the easement will need to be agreed upon by the
Waterstone Homeowners Association and the homeowners it represents. All of the
aforementioned is conditioned on the Windpointe deed restrictions and covenants that are
yet to be finalized and attached as conditions of the easement. We believe you have a
separate agreement with the HOA pending your review.
In addition, as of the writing of this letter we have not received any formal legal review
as to assumption of liability on the easement property. Any final agreement between us is
dependent on a satisfactory negotiation as to insurance, damage, personal and property
liability. The effect of sale of either property will need to be determined as well.
We hope this letter meets your requirements at this time.
