Mustang Chase Drive Garage, Saddle Creek The applicant seeks the following development standards variance approval: Docket No. 07050015 Section 25.01.01.B.3.b minimum side yard setback The site is located at 1740 Mustang Chase Drive and is zoned S 1/Residential. Filed by Nivad Navid-Azarbaijani, owner. General Info: The petitioner seeks variance approval to construct a third bay on the west fayade of his existing, two-car garage. The garage addition would be approximately two feet from the property line, instead of the required ten feet. The property is adjacent to common area on the west. Analysis: , . ( Several houses in this subdivision have three-car garages, with the third bay being set back from the main house in a manner similar to that proposed for the subject site. The proposed addition would not therefore be out of character. It would be constructed using the same materials and colors as the existing house. In addition, although the setback would be reduced by eight feet, the proposed garage addition would be adjacent to common area, and would not therefore impact any adjacent neighbors. The common area would also help minimize the visual impact of the reduced setback. Findings of Fact: right-of-way setback 1.) The approval of this variance will not be injurious to the public health, safety, morals, and general welfare of the community because: the proposed garage addition would match the existing house, be compatible with surrounding houses, and be adjacent to common area. 2.) The use and value of the area adjacent to the property included in the variance will be not affected in a substantially adverse manner because: the proposed garage addition would match the existing house, be compatible with surrounding houses, and be adjacent to common area. 3.) The strict application of the terms of the Zoning Ordinance to the property will result in a hardship in the use of the property because: the proposed garage addition could not be constructed, possibly resulting in additional cars parked in the driveway and on the street. Recommendation: The Dept. of Community Services recommends positive consideration of Docket No. 07050015 DSV (setback).
