NOTE: LEGAL NOTICE shall be published in the Indianaoolis Star a MANDATORY twenty-five (25) days prior to the
public hearing date. The certified "Proof of Publication" affidavit for the newspaper must be available for inspection the
night of the hearing.
LEGAL NOTICE to all adjoining and abutting property owners is also MANDATORY, two methods of notice are
recommended:
1) CERTIFIED MAIL- RETURN RECEIPT REQUESTED sent to adjoining property owners. (The white receipt
should be stamped by the Post Office at least twenty-five (25) days prior to the public hearing date.)
2) HAND DELIVERED to adjoining and abutting property owners (A receipt signed by the adjoining and abutting
property owner acknowledging the twenty-five (25) day notice should be kept for verification that the notice was
completed)
REALIZE THE BURDEN OF PROOF FOR ALL NOTICES IS THE RESPONSIBILITY OF THE APPLICANT. AGAIN, THIS

Mr. Navid, I am in receipt of your faxed drawings. Based on what you are showing, everything looks good for
approval.
Please note, however, as follows:
It appears it will be necessary that during construction, some of the equipment and work will need to be done in
the common area next to your house. It will be important for your crews to limit the damage to the common area,
the time frame the damage will take place, and that the common area damage be repaired to its original state. We
would like the construction (time of ground breaking to completion and repair of the common area) to be no longer
than (60) days. Once complete, be careful not to enhance or otherwise improve the common area next to the new
addition without express written consent from the Saddle Creek HOA.
Thank you for your submittal and good luck with your project.
Donna, Carl, please see that Mr. Navid receives written approval with the caveats described.
